17.1 Purpose. This chapter provides for the
delegation of authorities to the Director, Office of Law Enforcement and
Security (OLES).
17.2 Delegation. The following
authorities delegated to the Assistant Secretary - Policy, Management and
Budget are further delegated through the Deputy Assistant Secretary - Law
Enforcement, Security, and Emergency Management to the Director, OLES:
A. Authority
to carry out the program functions and management responsibilities in

B. Authority to issue policy, interim policy,
and guidance affecting Departmental law enforcement, security, homeland
security, and intelligence programs.
C. Authority
to hire and authorize commissioned law enforcement personnel to exercise law
enforcement authority.
D. Authority
to oversee, coordinate, and review law enforcement and security budgets for bureaus
and offices.
E. Authority to coordinate, evaluate, and
implement the Department's response to Homeland Security Presidential
Directives and other law enforcement, security, homeland security, and
emergency mandates and Executive Orders.
F. Authority
to make decisions about the Department’s law enforcement resources including,
but not limited to, deployment strategies, allocation of officers to disaster
sites, and tactical operations when a determination is made by a properly
authorized official that a national emergency or catastrophic/critical incident
is occurring or about to occur. (A
National emergency is defined as a situation that could result in, or has
resulted in, a Presidential Declaration of a National Emergency. A catastrophic/critical Incident is a serious
incident including, but not limited to, a terrorist action, a life threatening
situation, a natural disaster or a significant threat to Departmental resources.)
17.3 Limitation. Authorities delegated in paragraph F
above may not be redelegated and will terminate when a determination is
properly made that the circumstances giving rise to the delegation no longer
exist.
17.4 Redelegation. Except where further delegation is
prohibited by statute, Executive Order, or limitation established by other
competent authority, the authorities listed in paragraphs A - E above may be
further delegated.
