Description: The state regulates off-premise advertising signs that are visible to state highways and some former state highways. On premise signs do not require a permit. 'On premise' is specifically defined in OAR 700-059-0005, and does not mean property ownership. This permit allows you to build, reconstruct, or relocate an outdoor advertising sign visible to a state highway. Maximum sign size allowed under statute is 48' length x 14' height. Cutouts (irregular form attached to sign and extending beyond the borders of the sign) up to 20% of the standard area of the sign are allowed.

Fees - application, exam, etc.:  Determined by square footage of sign, counting both sides of a back-to-back sign.
25 sq ft or less = $125.
26 to 50 sq ft = $300.
51 to 400 sq ft = $500.
401 sq ft or more = $600.

Prerequisites: Must have an existing permit or relocation credit to be able to obtain a new permit. The number of permits is capped at 1975 levels. When an owner removes a permitted sign, the corresponding permit number may be used by the owner to obtain a permit for a sign in a new location, or the permit may be banked for later use. These banked permits or "relocation credits" are transacted in the private market. With a relocation credit, you may apply to relocate that permit with a new sign. With few exceptions, relocation is limited to 100 road miles from the location on 9/1/1977. For existing permits / relocation credits of a size less than 250 sq ft, or for a sign to be relocated so as to be visible to an interstate, the size of the new sign is limited to no more than the permitted size as of 5/8/1990. For those over 250 sq ft, permitted sign size may be up to maximum allowed by statute. The sign must be constructed in a commercial or industrial zone. If zoned after 1/1/73, must show site is within 750' of commercial or industrial development. Signs must comply with local jurisdiction's regulations. Signs are prohibited in Protected Areas along the interstates, Scenic Byways, and Designated Scenic Areas. Signs must be appropriately spaced from other Outdoor Advertising Signs, Interchanges on interstates and freeways, and Beautification Purchase sites. Required Documentation: 1. Permit application, which includes information and signature from local planning authority, and completion of site field check by your local ODOT office;
2. proof of ownership of existing permit or relocation credit (should be on file with our office);
3. written consent from property owner for applicant to place sign at that location. If site zoned commercial or industrial after 1/1/73, need plot plan showing current commercial or industrial development within 750' of sign site.
