Description: Any person may petition the Department of Environmental Quality to approve an equivalent testing or analytical method or may petition the Environmental Quality Commission to exclude a waste produced at a particular facility.

Fees - application, exam, etc.:  Petitions for hazardous waste exclusions shall be assessed a standard fee of $30,000.

Required Documentation: Persons submitting petitions shall comply with the requirements of 40 CFR 260.20. After evaluating all public comments, the Department or Commission as appropriate will make a decision to grant or deny the petition.
