Description: An applicant for a permit for an onsite sewage disposal system may request a variance from any rule or standard for onsite systems. After a hearing, a variance officer may grant the variance if strict compliance with a rule or standard is inappropriate or special physical conditions render strict compliance unreasonable, burdensome, or impractical. The variance may include conditions necessary to protect the public health and waters of the state.In cases of extreme and unusual hardship, an applicant denied a variance under OAR 340-071-0415 may request the Environmental Quality Commission to grant a hardship variance. The Commission may consider advanced age; poor health; need to care for aged, incapacitated or disable relatives; and environmental impacts.

Prerequisites: Please see the "Provide the Following Attachments:" section of the application. Furthermore, a minimum of two test pits must be provided within the specific area where the actural variance system is being proposed. The pits should be approximately two feet wide, four feet long, and excavated to either bedrock or to a depth of five feet. Similar pits must be provided in the area of the repair system. The Variance Officer may require the proposed drainfield and the future replacement drainfield be staked out.
