Permit By Notification

The Permit By Notification (PBN) is a new streamlined permitting process for certain minimum impact projects that propose impacts to resources protected under the Dredge and Fill Law, RSA 482-A. The rules and process identify certain projects in wetlands or surface waters or other protected resources areas that are minimum impact, if carried out according to the requirements in the rules.

Anyone who proposes work that qualifies for the permit by notification process is required to complete the Permit By Notification Form (with attachments) and submit it to the DES Wetlands Bureau through the municipal clerk.

The intent of the permit by notification is to save the applicants the time of waiting for DES approval, while protecting the environment and providing standards under which the minimum impact work must be accomplished.

What activities are eligible?

The following activities may be eligible as long as they are not proposed in bogs, marshes, sand dunes, undisturbed tidal buffer zones, a wetland identified by the Natural Heritage Inventory, or in or adjacent to municipality designated prime wetlands. Only certain maintenance projects in tidal wetlands may be eligible for the Permit By Notification.

  3. Maintenance dredging of nontidal drainage ditches, man-made ponds and nontidal spillways. Adobe Acrobat Reader Symbol
  4. Maintenance and repair of non-docking structures. Adobe Acrobat Reader Symbol
  5. Construction of a temporary cofferdam or other temporary water control devices. Adobe Acrobat Reader Symbol
  6. Temporary impacts associated for maintenance and repair of existing utility lines. Adobe Acrobat Reader Symbol

  7. Construction of a seasonal dock in nontidal waters.
  8. Construction of an anchoring pad for a seasonal pier.
  9. Installation of a seasonal boatlift.
  10. Installation of a seasonal personal watercraft lift.
  11. Repair of existing docking facilities.
  12. Repair or replacement of an existing retaining wall.
  13. Replenishment of an existing nontidal beach.
  14. Installation or repair of dry hydrant.
