A place is a funeral establishment if the place is used for the care and preparation of dead human bodies before the bodies undergo cremation, entombment or burial, or before the bodies are transported out of the State of Oregon. A funeral establishment must: (a) Be licensed by the State Mortuary and Cemetery Board under ORS 692.146; (b) Be operated by a funeral service practitioner; (c) Have on the premises embalming facilities or holding room facilities meeting requirements established by the Board; and (d) Have access to hospital or mortuary refrigeration.

Only a licensed funeral establishment shall: (a) Have facilities for the care and preparation, processing and handling of human remains before the remains undergo cremation, entombment or burial, or before the remains are transported out of the State of Oregon; (b) Offer embalming, employ a licensed embalmer, have on premises either a preparation room or holding room facility to care for and prepare human remains; and (c) Offer formal viewing of human remains.

Fees - application, exam, etc.:  Initial applications for a funeral establishment license must be submitted with a $150 fee plus $50 for each additional principal.
Renewal fee is $700 per biennium.
Responsible Agency: Mortuary and Cemetery Board
Prerequisites: A funeral establishment must be licensed by the Oregon Mortuary and Cemetery Board and must be operated by a licensed funeral service practitioner. A person may not operate a funeral establishment unless the establishment meets the necessary requirements.

Each licensed facility must be registered with the Board by its true corporate, firm or individual name. In addition, one assumed business name (ABN), as registered with the Corporation Division, may be used by each licensed facility. The name shall contain the identification of the activity, business or profession of funeral service as set forth in ORS Chapter 692 and the rules adopted thereto. This identified name shall be the registered name with the Board and shall also be utilized as the advertised name of the funeral establishment.

OAR 830-040-0040 provides that all license applications shall specify the real and true names of the person(s) who own or have an interest in the business proposed for licensure, including percentages of ownership and corporate information. Applications must also specify the names of all principals. If the principal is a corporation, the application shall include the names of all principals of that corporation.

Principal means those persons who have controlling authority over the licensed facility, including but not limited to: (a) Managers or other persons who have decision making authority and whose primary duties include control over the operation of the licensed facility; (b) Officers or directors who have some degree of responsibility for the operation of the licensed facility; (c) Stock holders or corporations who own or control ten percent or more of the licensed facility by owning or controlling ten percent or more of the voting stock; and (d) Partners.

All applicants for a funeral establishment license and principals of licensed facilities must submit to a background investigation.

Each branch of a licenseeĆ½s funeral establishment is a separate establishment and must be licensed at a fixed place of business.

If the funeral establishment is conducting preneed sales of funeral goods and services funded by trusts, it must be registered with the Department of Consumer and Business Services and comply with the provisions of ORS 97.923 to 97.949.

Renewals: Prerequisites:
The Board shall mail a notice to each licensed funeral establishment, addressed to the licensee at the licensee's last-known address, a notice that the renewal fee is due and payable and that if the fee is not paid by the renewal date the funeral establishment license shall lapse.

The notice will be mailed on or before November 1 of every even numbered year. The renewal form must be completed and returned with the renewal fee by December 31.

If the renewal is postmarked after December 31, the licensee must include a reinstatement fee of $50 per license. Failure to renew and pay all fees within 90 days of December 31 will result in a permanently lapsed funeral establishment license.

Completed signed Notice of License Expiration and License Renewal Application with required fee(s) must be received in the office of the Board by the renewal date, or be postmarked before midnight of that date.

Additional Information: Once the application is processed, background investigations have been completed, paperwork has been reviewed and corrected if necessary and any other issues resolved, a final inspection will be scheduled with an investigator/inspector.
