Description: An Operating Permit is required for mining operations that have an activity level that exceeds one acre and/or 5,000 cubic yards of new disturbance in any 12-month period, unless the excavated material stays on the property.

Duration: 1 year
Fees - application, exam, etc.:  $1,260

The permit is renewed annually until mining and reclamation are complete.
Responsible Agency: Geology and Mineral Industries
Bonding Requirements: Reclamation security is required. The amount is site-specific. Forms of security include performance bond, assignment of deposit (15,000 max), letter of credit, and cash.
Application Form: Operating Permit Application
Renewals: The expiration date is the last day of the month in the year following the receipt of the application, then renewed annually until mining and reclamation are complete. The base renewal fee is $635 plus an additional $.0075 per ton on annual production.

Required Documentation
The completed Annual Report and Renewal Notice form with production information for the previous 12-month period must be returned with the renewal fee.

For sites on floodplains, in hydrologically sensitive areas, or on steep slopes, data collection and other info may be required. Contact us to determine if this applies and what data/info will be required.
