Description: |
The Department of Environmental Quality certifies hydroelectric projects as authorized by Section 401 of the federal Clean Water Act. Section 401 requires the applicant for a federal license or permit to conduct any activity that may result in a discharge to waters of the state, including hydroelectric projects, to provide to the licensing or permitting agency a certification from DEQ that the activity complies with water quality requirements and standards.
Water related projects often require multiple permits. Please see Common Water Related Projects for information on other permits that may be required to accomplish your project. |

The fee includes all expenses incurred by the Environmental Quality Commission and Department of Environmental Quality related to the evaluation of and decisionmaking on the application. The fee may include consulting costs for legal services and project studies and evaluation. (ORS 468.065) |

Prerequisites: |
No prerequisites for Section 401 certification. The Federal Energy Regulatory Commission, which licenses major hydroelectric projects, has a licensing process that takes a minimum of 5.5 years, including a number of interim milestones.
