Description: |
Under the Federal Clean Air Act, a state program must include the opportunity for the state agency to review all new construction of air emissions sources before an owner or operator is allowed to begin construction. This applies to new sources and to changes or modifications of existing sources. Construction of equipment that will cause air pollution, or installation of emissions control devices, cannot commence without notification to the Department of Environmental Quality (DEQ). Changes that involve new construction or modifications of stationary sources or air pollution control equipment are divided into Types I, II, III, and IV. A detailed discussion of the types are described in OAR 340-210-0225. Only Type I and II changes can apply for a Notice of Intent to Construct (NC). Type III and IV changes must submit an application for either a Construction ACDP, new permit, or permit modification. |
