Sexual Assault Victim Emergency Fund

WHAT IS THE SAVE FUND?

The Sexual Assault Victim Emergency (SAVE) Fund provides payment for a comprehensive and accessible medical assessment to victims of sexual assault in the aftermath of crime. The SAVE Fund makes medical exams available to every victim of sexual assault in the state, regardless of ability to pay. The SAVE Fund, administered through the Crime Victims' Services Division, pays for the cost of a sexual assault medical exam. If the victim reports the crime, SAVE also pays providers to collect forensic evidence using the procedures established by the Oregon State Police. If requested by the victim, medications to prevent sexually transmitted diseases will also be provided.

PURPOSE

The purpose of the SAVE Fund is to ensure greater access to medical assessments for victims of sexual assault, regardless of ability to pay.  A victim needs only to request that an eligible medical provider perform a sexual assault exam within 7 days of an assault in order to be eligible for the exam to be paid by the SAVE Fund.  The exam may or may not include evidence collection, sexually transmitted disease (STD) prophylaxis and/or emergency contraception.  An easy to complete, confidential, one page form will be completed at the medical facility and submitted by the medical facility for payment.

The SAVE Fund pays for any of or all the elements of a "Complete" Medical Assessment, which includes the collection of forensic evidence and must be conducted within 84 hours of the assault; and for any of or all the elements of a "Partial" Medical Assessment which does not include the collection of forensic evidence and must be conducted within 7 days of the assault.

HISTORY

Requested by the Attorney General's Sexual Assault Task Force, the Fund was created by the passage of Senate Bill 752 (SB 752) in the 2003 regular legislative session. SB 752 repealed ORS 147.375 that required law enforcement agencies to pay for forensic medical evidence collection. Instead, victims may choose to have medical providers bill the Fund directly and law enforcement agencies will incur no cost.  The Oregon Revised Statute created as a result of the passage of SB 752 is located in Chapter 147 in the Oregon Revised Statutes. Chapter 137 of the Oregon Administrative Rules concerns the SAVE Fund.
