Freedom of Information Act – Information Concerning the Office of the State Fire Marshal (OSFM)

OSFM’s mission is to improve safety by increasing public awareness about fire hazards, public safety codes and fire prevention while also enhancing firefighting and emergency response capabilities to local communities. OSFM currently employs approximately 147 full and part-time employees and has an operating budget of approximately $27.6 million. This block diagram identifies OSFM’s functional divisions.

Q: How do I file a FOIA Request?

A: Submit a written request identifying the documents requested and the name, address and telephone number of the requestor by US mail, special carrier, email or facsimile to the Freedom of Information Officer as follows:

Q: What are the fees charged for a FOIA request?

A: Effective May 11, 2009, FOIA requests for Underground Storage Tank facility files will be $3.00 per address. The fee for all other FOIA requests will be .15 per page, with the first 5 pages of a request being provided for free. Reproduction of photographs will be .50 per image, or the actual cost of reproduction as stated herein. In the event the OSFM determines, within its sole discretion, that a commercial copying or reproduction service is needed to reproduce documents and/or images, the actual cost of copying will be charged. A waiver of the fee may be available in accordance with the Freedom of Information Act (5 ILCS 140/6).

Q: How will I know how much money to send with a request?

A: Unless you are sending in a $3.00 fee for each UST facility address requested, you will not know the fee amount. OSFM requires the requestor to provide a telephone number and address with the FOIA request so that OSFM can contact the requestor and notify him or her of the fee amount required.

Q: Will OSFM send me the documents and then let me pay the fee?

A: No. The fee must either accompany the request or be paid prior to the documents being sent to the requestor.

Q: How do I acquire a list of Underground Storage Tanks (USTs) or UST facilities?

A: OSFM no longer provides a list of USTs on a CD. This information can be downloaded or printed from OSFMs website at http://webapps.sfm.illinois.gov/ustsearch/.

Q: What information do I need to provide to OSFM in order to obtain information from a UST facility file?

A: In addition to the requestor’s name, address and telephone number, the written request for information should include the facility number (if known) or the address of the facility.

There is a $3.00 fee per address or facility number.

Q: What information do I need to provide to OSFM in order to obtain a fire report?

A: In addition to the requestor’s name, address and telephone number, the written request for information should include the complete address and the date of the fire.
