FCC Suspends Collection of the July 2002 Amended Schedule of Application Fees;
July 2000 Schedule of Application Fees Continues In Effect Until Further Notice


By this Notice, we are suspending the collection of the increase in application fees set forth in Section 1.1102 through 1.1107 of the Commission’s Rules, 47 C.F.R. § 1.1102 – 1.1107, announced in the Commission’s Order of July 12, 2002, GEN Docket No. 86-285, FCC 02-202. Filings requiring application fees should continue to tender the fees as set forth in the Schedule of Application Fees, GEN Docket No. 86-285, FCC 00-286 (2000), posted at www.fcc.gov/Bureaus/OMD/Orders/fcc00286.pdf, until further notice.

This action is required because the July 12 Order amending the Schedule of Application Fees the net change in the Consumer Price Index (CPI), as required by section 8(b) of the Communications Act of 1934, as amended, 47 U.S.C. § 158(b), stated that it would go into effect on September 10, 2002, on publication in the Federal Register. Inadvertently, the July 12 Order was not published in the Federal Register. Thus, neither the changes in the Schedule of Application Fees, nor the other changes in the application fees rules contained in the July 12 Order, have gone into effect.

To correct this administrative oversight, the Commission will issue an Order changing the effective date of the amended Schedule of Application Fees and the other rule changes. The July 12 Order and the amended effective date will be published in the Federal Register as soon as possible. The Commission will also issue another Public Notice announcing the specific date when the amended Schedule of Application Fees and application fee rule amendments will go into effect.
