Minimum Qualifications:

  • Requires bachelor degree in real estate, economics, finance, business administration, or another major that provided the knowledge and skill required to perform the assigned duties, plus four years of work experience in eminent domain appraisal and acquisition. Or ten years of work experience in real estate, economics, finance, business administration, or another field that provided the knowledge and skill required to perform the assigned duties. Four years of the work experience must have included experience in eminent domain appraisal and acquisition. Applicant must have current certification (‘Certified General’) through the North Dakota Appraiser Qualifications & Ethics Board (NDAQEB).  Applicants not certified in North Dakota but otherwise possessing equivalent certification in another state are eligible for consideration but will be required to obtain Certified General status through NDAQEB within three months of being hired.
  • Ability to express ideas clearly and concisely, both orally and in writing in normal and stressful conditions; communicate clearly to avoid confusion and misunderstanding with other employees, customers, or the public; remain calm and composed when dealing with distraught or angry employees or members of the public; public speaking skills; read, interpret, or explain applicable standards, technical literature, regulations, plans, and specifications; accurately and clearly complete required paperwork; prepare written or oral reports frequently in tight time frames; complete forms, compute fees, and be mathematically inclined; memorize policies and procedures;  requires valid Class D drivers license to travel to public meetings and project locations; use of phone, calculator, copier, tape recorder, reference sources, research documentation;  keyboarding familiarity; use of personal computer with word processing, database,  financial, statistical, spreadsheet, and technical software.
  • Ability to work closely with people; contact with the public; establish and maintain effective working relationships with associates and others; function with minimal supervision; be flexible in daily schedule; work under stress; remain calm and maintain focus under demanding and often conflicting work schedule with rapid shifts in priority; work after hours, on weekends, and holidays during road and weather emergencies is required;  presence during deadlines and high stress periods of work is mandatory; regular attendance is essential to efficiently process the volume of work in this position; regular attendance is critical in this position because the expertise this employee is providing will not be available from any other source.
  • Requires normal vision with or without correction; normal hearing range with or without correction; eye-hand coordination; work in all types of weather on a variety of uneven or slippery surfaces; lifting or carrying several items with a total weight of 50 pounds;  physical mobility, agility, and mental alertness compatible with an office and construction project setting; practices, principles standards and guidelines as related to Uniform Appraisal Standards for Federal Land Acquisitions; Uniform Standards of Professional Appraisal Practice; Uniform Relocation Assistance & Real Property Acquisitions Policies Act; NDDOT Right of Way Manual.

Summary of Work:

ESSENTIAL FUNCTIONS

  1. Prepare eminent domain appraisals: identify and conduct research and analysis of relevant social, economic, governmental, and environmental factors influencing value in real estate markets; research and analysis to provide supporting basis for appraisals and other valuation-related processes; prepare general narrative report to be used in conjunction with project appraisals, waiver valuations, and right of way acquisitions; prepare appraisals (uncomplicated or complex) for eminent domain purposes in compliance with Uniform Relocation Assistance & Real Property Acquisitions Policy Act, NDDOT's Right of Way manual, and according to accepted appraisal industry methods and standards of practice, including the Uniform Appraisal Standards for Federal Land Acquisitions (UASFLA) and the Appraisal Foundation's Uniform Standards of Professional Appraisal Practice (USPAP); maintain familiarity with highway, state, and FHWA plans, directives and appropriate files; maintain considerable familiarity with and knowledge of land economics, appraisal principles and methods, professional standards of appraisal practice, and federal and state laws/policies/regulations to provide appraisal function compliance; testify and defend opinions and value conclusions. Approximately 30 percent of time will be spent on this duty.
  2. Negotiation/acquisition: negotiate acquisition of all property types (farm/ranch, residential, commercial and industrial properties).  Acquisitions may be total or partial, permanent or temporary, and for a variety of purposes and levels of complexity; contact and act as liaison between owner of affected property owners and NDDOT in compliance with federal and state laws, rules, and regulations; prepare proper legal documents for acquisition of right of way interests. Obtain necessary signature(s) on all required documents, notarized as necessary; accurately prepare and maintain acquisition records, ownership contact reports, and other required documentation; basic process of negotiation/acquisition: familiarization with project, proposed acquisition, and its effects on remaining property; familiarization with supporting market data and property values, individual property appraisal reports; waiver valuations, initial and subsequent follow-up owner/negotiation contacts; conduct negotiations with property owner, acting as liaison between owner and NDDOT;  preparation of necessary documents; obtain signatures on documents; negotiating/acquisition agent also reads and interprets project plan-and-profile and cross-section plan sheets; agent explains information to property owner in layperson's terms. Approximately 25 percent of time will be spent on this duty.
  3. Other appraisal related work, research, studies and preparation: prepare ownership lists, cost estimates, and requests for federal authorization for funding participation in highway projects requiring right of way acquisitions; requires research and analysis of real estate market; conduct routine inspections; prepare preliminary cost estimates for projects; conduct studies to isolate impacts of access changes; conduct extensive market research to develop supported estimates of severance damages and special benefits, as circumstances warrant; studies, cost estimates, and other reports are prepared as needed to assist in project planning, scheduling, and implementation; prepare excess property appraisals to assist the department in the sale or leasing of excess land or other property (Sources and information obtained as in Duty 1); provide court preparation and expert witness testimony; consult with management and legal counsel as to reasonable settlement proposals and other similar appraisal and consulting work; assist Chief/Review Appraiser in consultations with state, city, county, and consultants on general right of way issues; conduct research of courthouse records to determine property ownership, existing easements and/or encumbrances, a variety of estate tax and special assessment data, preparation of "pencil abstracts" and similar work; selection, valuation and/or acquisition of stockpile sites, borrow option areas, waste easement areas and similar work; ability to write basic property descriptions for variety of needs including stockpile sites, borrow opinion and waste easement areas. Approximately 10 percent of time will be spent on this duty.
  4. Appraisal Reviews: conduct NDDOT and LPA compliance reviews under direction of Chief/Review Appraiser, this includes review of uncomplicated appraisals and other documentation to insure compliance with state and federal law, rules and regulations as applicable to projects involving the participation of federal funds; appraisal reviews to be conducted in compliance with the Uniform Relocation Assistance & Real Property Acquisitions Policy Act, NDDOT's Right of Way Manual, and according to accepted appraisal industry methods and standards of practice, including the Uniform Appraisal Standards for Federal Land Acquisition (UASFLA), and the Appraisal Foundation's Uniform Standards of Professional Appraisal Practice (USPAP), to the extent appropriate as dictated by agency policy. Approximately 10 percent of time will be sent on this duty.
  5. Other: provide technical assistance to staff negotiators, Local Government personnel, and others to resolve problems and expedite acquisitions; attend public hearings and /or citizen input meetings to answer questions regarding right of way and property valuation processes; attend early project planning meetings with other department divisions; conduct preliminary project inspections in advance of FHWA authorization requests to assess project acquisitions and appraisal needs; participate/contribute, on an on-going basis, to the assemblage and maintenance of the Right of Way Officer's body of knowledge and appraisal resources, studies, market trends, and supporting data, including the assemblage and continual maintenance of relevant social, economic, government, and environmental conditions and trends affecting value; market data bases (e.g. sales, listings, rents, financing records, ratio studies, and other information), the development and maintenance of studies (e.g. matched pair analysis, severance studies, etc.) and other information and analysis relevant to appraisals. Approximately 25 percent of time will be spent on this duty.
