Law Change Goes Into Effect August 1, 2009

Changes to NDCC 37-19.1-04 require that employers notify a veteran, or a qualified veteran’s spouse, of certain items if they were not given preference in employment.  The notice must include:  the reasons for non-selection, information on the right to an appeal hearing by sending a request by certified mail to the commissioner of veterans’ affairs within 15 days of notification and that if the applicant requests an appeal, the applicant must mail a copy of the request for an appeal hearing to the employer or employing agency.  Additional specific information may be found at NDCC 37-19.1-04.  A sample letter has been drafted that may be used by employers.

Minimum Wage Increase

The federal minimum wage increased to $7.25 per hour effective July 24, 2009.

Salary Ranges

The State Personnel Board, at its meeting on June 11, 2009, approved salary ranges for the next biennium.  Range movement for the 09-10 fiscal year varies from 5% to 9.5%, depending on market movement.  Range movement for the 10-11 fiscal year is 5%.

Family and Medical Leave Act

The U.S. Department of Labor published final rules [12.71mb pdf] implementing amendments to provide additional clarification and to extend leave protections to families of armed forces members as a result of the National Defense Authorization Act of 2008. More information may be found on the U.S. Department of Labor's website.

State agencies may use OMB's Family and Medical Leave policy as a guide in developing or revising their policies. The policy is under Chapter 8 in the OMB Human Resource Policy Manual.

Hiring Council

The intent is to hold a meeting on the fourth Wednesday of every month.
