Bidding Requirements and Conditions

General Information on Bidding Highway Construction Projects with the North Dakota Department of Transportation



Prequalification of Bidders

In accordance with the North Dakota Department of Transportation (NDDOT) Standard Specifications for Road and Bridge Construction, Section 102, a bidder must be prequalified by the Department in order to be eligible to submit bids, except when this provision is specifically waived by the contract provisions.

In addition, contractors need to meet the requirements of other agencies for conducting business in North Dakota. Information for conducting business in North Dakota can be obtained by visiting ND.Gov Business.

Bidder prequalification is required annually by the NDDOT. Prequalified contractors who wish to renew their prequalification must submit a complete "Contractor's Prequalification Statement" by July 1 of each calendar year. The NDDOT may grant an extension, not exceeding 60 days, when requested for valid reason. Contractors who are not currently prequalified must submit a complete "Contractor's Prequalification Statement" at least seven (7) days prior to the date of a scheduled bid opening on which they desire to submit bids. This statement must be signed by Owner; Partner; Corp. Pres.; Vice Pres., or other authorized Corp. Officer and notarized. (If signed by other authorized Corp. Officer, please attach copy of Power of Attorney or other documentation showing authority to sign.)

Contractor's License Requirements

A bidder is not required to obtain a North Dakota contractor's license prior to submitting a bid on a North Dakota Department of Transportation project. (N.D.C.C. Section 43-07-12) However, the successful bidder must, prior to the execution of the contract, have obtained the appropriate North Dakota contractor's license and secured workers’ compensation coverage from Workforce Safety & Insurance.

  • Notification of Projects Available to Bid

    Projects are advertised in the NDDOT publication entitled “Notice to Bidders”. The Notice to Bidders is available on the NDDOT website approximately four (4) weeks prior to the bid opening date. Notification that the Notice to Bidders is available is sent out by e-mail. To receive the email notification, sign up on the NDDOT bidinfo web page.

    Highway construction projects are also advertised in the local county newspaper at least three weeks prior to the projects bid date. 

    Projects may also be advertised via other means, such as the Construction Bulletin publication, through the Builders Exchange, etc…

    Examining Bid Documents (Plans, Proposals, Addenda, Soils Information, etc)

    As of August 2008, the NDDOT no longer prints or sells plans and proposals.  All bid documents (plans, proposals and other project information) are available on the NDDOT Electronic Plans and Proposals webpage.  The document files are posted in PDF format.  The document files can be viewed or saved to a computer.

    Paper copies of bid documents are available for examination at the Construction Services Division office on the 3rd floor of the Transportation Building on the State Capital grounds in Bismarck.

    A plan holders list is available on the Department’s website.  Instructions on how to get your company information put on the plan holders list is also posted on the website.

    Bid Preparation

    Obtain bidding proposals in accordance with the Advertisement for Bids. Submit bidding proposals using one of the following methods:
    •Electronic bid on the internet using Bid Express.
    •Electronic bid on a diskette with accompanying printout.
    •Paper bid. Any paper bid submitted without a diskette shall be accompanied by a check or money order payable to “North Dakota Department of Transportation” in the amount of $30 per Proposal.

    Delivery of Bidding Proposals
