Repairs and Upgrades to Historic Buildings Being Considered

The Recovery Act has provided the General Services Administration (GSA) with significant opportunities to repair and upgrade its historic buildings. However the rigid spending deadline in the Act has meant that the GSA must consider alternatives for identifying and assessing the effects of the repairs and upgrades as required by Section 106 of the National Historic Preservation Act.

The Advisory Council on Historic Preservation (ACHP) is now considering issuing a Program Comment to the GSA that would streamline Section 106 compliance for select repairs and upgrades to windows, lighting, roofing, and heating, ventilating and air-conditioning systems. The Program Comment would limit the repairs to projects executed by GSA employees and contractors who meet the professional standards developed by the Secretary of the Interior and would further limit the proposed repairs and upgrades so as not to adversely affect a building qualifying for the National Register of Historic Places. Issuance of the Program Comment could not only satisfy preservation compliance requirements but also facilitate GSA's efforts to meet its upcoming spending deadlines designated in the Recovery Act and reduce Recovery-related workloads for GSA, ACHP, State Historic Preservation Offices, and consulting parties.

Section 106 regulations emphasize that the public be given the opportunity to comment on issues surrounding work being done on an historic building by a federal agency. Once the public comments are considered, and edits are incorporated as deemed appropriate, the ACHP will decide whether to issue the Program Comment. The ACHP expects to make that decision at its upcoming quarterly meeting scheduled on August 7, 2009 in Washington, DC, or shortly thereafter.
