Abstract:
To ensure full public participation as EPA determines how and when to transition from the 1-hour ozone standard to the 8-hour standard, the Environmental Protection Agency (EPA) on Dec. 19, 2002, proposed to keep stay its authority to determine that the 1-hour standard no longer applies in areas meeting that standard.

The proposed stay would remain effective until such time as the Agency takes final action in a subsequent rulemaking.

Today's action is in response to a negotiated settlement agreement between EPA and the Environmental Defense and Appalachian Mountain Club. The litigants agreed to dismiss their cases against EPA if today's action occurs and becomes final. This file is the text of the proposed stay
