Filing a New Case Forms you will need: A written statement in which the plaintiff describes the claims against the defendant. This document starts a civil action in United States Court. A document that is served along with the complaint on the defendant letting them know that a civil action has been filed against them. A Latin word meaning "written request for an action". File this form if you do NOT want summons issued. This form provides information to the Clerk's Office that is necessary to properly open a case.
