ORDER NO. 83-3
FOREST DEVELOPMENT ROADS
PACIFIC SOUTHWEST REGION

Pursuant to Title 36, Code of Federal Regulations, Subpart B, Section 261.50(b), the following is prohibited on National Forest Development roads under my jurisdiction:

  1. Operating a vehicle on any road posted as closed to traffic or restricted as to use by traffic. 36 CFR 261.54(a) and (b).
  2. Using a road for commercial hauling without a permit or written authorization. 36 CFR 261.54(c).
  3. Operating a vehicle in violation of a posted speed, load, weight, height, length, width, or other posted limitations. 36 CFR 261.54(d).
  4. Operating a vehicle carelessly, recklessly, or without regard for the rights or safety of other persons or in a manner or st a speed that would endanger or be likely to endanger any person or property. 36 CFR 261.54(f).

Pursuant to 36 CFR 261.50(e), each of the following is exempted from this order:

  1. Any Federal, State, or local officer, or member of an organized rescue or firefighting force in the performance of an official duty; and
  2. Persons with a permit easement or contract specifically authorizing the otherwise prohibited use.

This order supersedes all previous Regional Forester and Forest Supervisor orders pertaining to 36 CFR 261.54(a), (b), (c), (d), and (f).

These prohibitions are in addition to the general prohibitions in 36 CFR, Part 261, Subpart A.

Violation of these prohibitions is punishable by a fine of not more than $500 or imprisonment for not more than 6 months or both. See 16 U.S.C.551.
