ORDER OF
DISMISSAL
This case arises under Title VII of the Civil
Service Reform Act of 1978 (CSRA) (5 USC § 7120; Act of
October 13, 1978, 92 Stat. 1192 etseq.), the
reporting requirements for labor organizations as set forth in
Section 201 of the Labor Management Reporting and Disclosure Act
of 1959 (LMRDA), as amended (29 USC § 401 etseq.) and Parts 402, 403, and 408 of 29 CFR Chapter IV,
which are applicable to labor organizations subject to the
requirements of CSRA pursuant to Section 458.3 (29 CFR §
48.3) of the Standards of Conduct regulations.
On May 28, 1996, DOL filed a Complaint in this
Office against Respondent. DOL alleges that Respondent failed to
file a Labor Organizational Annual Financial Report for FY 1993
and 1994 as required. This Office issued a Notice of Docketing
and Pre-Hearing Order on June 13, 1996 which required each party
to file certain information regarding this matter. On July 10,
1996, DOL filed a Motion for Extension of Time to file a
response, which was granted on August 12, 1996. On August 26,
1996 DOL filed a Motion to Dismiss stating that Respondent has
complied with the Act and regulations by filing the annual
financial reports for 1993 and 1994.
Accordingly, it is hereby ORDERED that this
matter be DISMISSED.
