This proceeding arises under § 16(e) of
the Fair Labor Standards Act of 1938, as amended (29 U.S.C.
§ 216(e)) and the regulations issued pursuant thereto at 29
C.F.R. Parts 579 and 580.
On July 16, 1996, Respondent filed with this
Office a Withdrawal of Contest. Respondent enclosed a copy of a
check in the amount of $16,275.00 payable to the U.S. Department
of Labor, representing full payment of the assessed penalties.
