NOTICE OF ADMINISTRATIVE CLOSING
This case arose under the whistleblower protection provisions of the Sarbanes-Oxley Act of 2002, 18 U.S.C.A § 1514A (West 2002). On August 26, 2003, a Department of Labor Administrative Law Judge (ALJ) issued a Decision and Order Granting Respondent's Motion for Summary Judgment (D. & O.).
The Complainant, Paul A. Walker, filed a Petition for Review with the Administrative Review Board on September 8, 2003. Pursuant to 29 C.F.R. § 1980.110(b)(2003):
If a timely petition for review is filed pursuant to paragraph (a) of this section, the decision of the administrative law judge will become the final order of the Secretary unless the Board, within 30 days of the filing of the petition, issues an order notifying the parties that the case has been accepted for review.
The Board did not issue an order accepting this case for review. Accordingly, the ALJ's D. & O. became the Secretary's final order as of October 8, 2003, and this case is hereby CLOSED.
