Subject: Redelegation of Personnel Management Authority

A. Purpose. This instruction outlines the redelegation of personnel management authority from the Assistant Secretary for Occupational Safety and Health to management officials within the Agency.

B. Scope. This instruction applies OSHA-wide.

C. Cancellation. OSHA Administrative Directive ADM 4.1, October 30, 1978, (formerly OSHA Administrative Directive ADM 4.0-2, November 13, 1974) is cancelled.

D. Delegation. Subject to budgetary, employment and average grade limitations, and to the provisions of applicable laws, regulations, policies, standards and procedures, the following redelegation of personnel management authority is hereby authorized:

1. Redelegation of Authority - National Office.
a. The Deputy Assistant Secretary. Is hereby delegated authority to act in all matters within the authority delegated to the Assistant Secretary"
b. Program Directors and the Director of Field coordination. The Directors of the Directorates of Administrative programs; Federal Compliance and State programs; Health Standards programs; Safety Standards programs; policy, Legislation, and Interagency programs; Technical Support; Training, Education, Consultation and Federal Agency programs; the Office of Information and Consumer Affairs and the Office of Field Operations Coordination are redelegated authority to take all personnel actions including, but not limited to, adverse actions, IPA assignments, removing supervisors during probationary period for performance, establishing performance standards and making Merit Pay decisions involving all

Office positions in the competitive service in grades GS-15 and below within their respective organizations. This redelegation of personnel management authority does not include the authority for approving the classification of positions or establishing expert, consultant, or Schedule C positions.
c. The Director of Administrative Programs. Is hereby delegated authority for personnel management as specified below:
(1) Classification of all positions through GS-15 in the National Office and at GS-15 in the Field. Prior approval of the Assistant Secretary for Administration and Management (OASAM) is required for classification authority not redelegated to the Agency.
(2) Effect final approval of all personnel actions in the National Office and at the GS-15 level in the Field. However, this authority does not extend to final approval of actions involving OSHA SES positions or non-SES supergrade positions.
(3) The OSHA Office of Personnel Management has the final responsibility for authenticating all personnel actions in the National Office and positions at the GS-15 level in the Field. This authority does not extend to actions involving OSHA SES positions or non-SES supergrade positions.
d. The Field Coordinator. Is hereby delegated authority to make agency decisions in matters of adverse actions proposed by Regional Administrators.
e. Limitations on Personnel Management Authority for GS-14 and Above Actions. Prior to effecting any final action involving GS-14 level or above positions, Program Directors and the Field Coordinator must obtain the concurrence of the Assistant Secretary.
f. Redelegation. Program Directors and the Field Coordinator shall redelegate their personnel management authority to office directors and other staff as required for efficient personnel management purposes, however, the authority to make Merit Pay decisions may not be redelegated below the Program Director level or below the level of the Field Coordinator. Submit copies of all redelegations of authority to the OSHA Office of Personnel Management and the OSHA Office of Management Systems and Organization.

2. Redelegation of Authority - Field Operations.
a. GS-14 and Below Actions. Regional Administrators are delegated authority to take personnel actions including, but not limited to, adverse actions, IPA assignments, removing supervisors during probationary period for performance, establishing performance standards and making Merit Pay decisions involving Field positions in the competitive service in grades GS-14 and below within established staffing patterns and average grade, employment ceiling, and budgetary allowance restrictions. This redelegation of personnel management authority does not include the authority for approving the classification of positions or establishing expert, consultant, or Schedule C positions. Submit personnel actions at GS-14 requiring OASAM classification approval through the Regional Administrator -OASAM. Forward a copy of the papers to the OSHA Personnel Office.
b. GS-15 Actions. Regional Administrators must establish performance standards and make Merit Pay decisions for Deputy Regional Administrators. Actions involving personnel changes in regional positions at tie GS-15 grade level will be effected at Agency headquarters. Final authority for these actions has been delegated to the Field Coordinator. When such changes are contemplated, the Directorate of Administrative Programs will consult with the Regional Administrator in the affected region. Proposed vacancy announcements will be furnished by the OSHA Personnel Office to the Regional Administrator via facsimile transmission or by mail for concurrence, suggested changes, and nomination of candidates.
c. Limitations on Personnel Management Authority for GS-14 and Above Actions. Prior to effecting any final personnel action involving GS-14 or GS-15 level positions, Regional Administrators must obtain the concurrence of the Field Coordinator and the Assistant Secretary.
d. Redelegation. Regional Administrators shall redelegate their personnel management authority to Area Directors and other staff as required for efficient personnel management purposes. Regional Administrators may not redelegate their authority to make pay determinations under Merit Pay. Submit copies of all redelegations of authority to the servicing OASAM Office of Personnel Management, the OSHA Office of Personnel Management, and the OSHA Office of Management Systems and Organization.
