Air Quality Announces New Documentation Requirements

Beginning October 1, 2008, Maricopa County is required by law to seek proof of an individual's legal presence in the United States before issuing a permit or license to operate a business.

 

New provisions of the Legal Arizona Workers Act (A.R.S. § 41-1080) require documentation indicating an individual's presence in the United States is lawful, and such documentation must be presented prior to any license or permit being issued to operate a business.  The required documents include one of the following:

 

1.)       An Arizona driver’s license issued after 1996 or an Arizona Non-Operating Identification License,

2.)       A driver’s license issued by a state that verifies lawful presence in the United States,

3.)       A birth certificate or delayed birth certificate issued in any state, territory or possession of the United States,

4.)       A United States certificate of birth abroad,

5.)       A United States passport,

6.)       A foreign passport with a United States visa,

7.)       An I-94 Form with a photograph,

8.)       A United States Citizenship and Immigration Services Employment Authorization Document or Refugee Travel Document,

9.)       A Certificate of United States Naturalization,

10.)    A Certificate of United States Citizenship,

11.)    A tribal Certificate of Degree of Indian Blood or

12.)    A tribal or Bureau of Indian Affairs Affidavit of Birth.

 

This new law does not prohibit an individual from applying for an air quality permit; however, permits will not be issued until proper documentation is received. Permit applications can be found on the Maricopa County Air Quality Department’s website: www.maricopa.gov/aq.
