Air Quality Violators pay over $440K in February
The Maricopa County Air Quality Department announces $440,302.90 in air quality violation settlements during the month of February. The settlement cases for February are listed below including the following three highest settlements for the month:
Pulte Homes Corporation signed a settlement agreement for $160,000.00 on February 12th to resolve 44 alleged air quality violations. The alleged violations include: failure to obtain an earthmoving permit; failure to install, maintain and use a suitable trackout control device; failure to immediately clean up trackout, carryout, spillage and/or erosion; failure to cover haul trucks; failure to load all haul trucks such that the freeboard is not less than three inches; failure to implement control measures before, after and while conducting operations; failure to operate a water application system while conducting earthmoving operations; failure to keep a complete permit clearly visible and accessible onsite; failure to keep a copy of the approved Dust Control Plan available onsite at all times and failure to erect and maintain a project information sign. These alleged violations occurred at various locations from 2004 through mid 2007. A list of those locations is in the table below. Pulte Homes’ office is located at 15111 N. Pima Road in Scottsdale. The settlement was paid in full on February 29, 2008.
APS – Palo Verde Nuclear Generating Station signed a settlement agreement for $79,619.45 on February 25th to resolve three alleged air quality violations. These alleged violations include: failure to comply with trackout requirements; failure to limit particulate matter emissions less than 10 microns in diameter (PM-10) to less than 54 tons on a 12-month rolling total basis and failure to limit particulate matter emissions less than 10 microns in diameter (PM-10) to less than 5.6 tons per month. These violations occurred at the two following locations:
· 107th Avenue & Broadway Road in Avondale
· 5801 S. Wintersburg Road in Tonopah
APS – Palo Verde Nuclear Generating Station’s office is located at 5801 S. Wintersburg Road in Tonopah. The settlement was paid in full on February 25, 2008.
J L Hardy Construction, Inc. signed a settlement agreement for $63,000.00 on February 8th to resolve 21 alleged air quality violations. The alleged violations include: failure to install, maintain and use a suitable trackout control device; failure to erect and maintain a project information sign; failure to immediately clean up trackout, carryout, spillage and/or erosion; failure to implement control measures before, after and while conducting dust generating operations; failure to post a copy of the approved Dust Control Plan or otherwise keep available onsite at all times; failure to keep a daily written log recording the control measures in the Dust Control Plan; failure to comply with stabilization requirements for open areas and failure to post a permit that is clearly visible or accessible onsite. The alleged violations occurred at 1703 W. Bethany Home Road in Phoenix. J L Hardy Construction’s office is located at 3586 W. 900 S. in Salt Lake City. The settlement is due in full on July 11, 2008.

The Maricopa County Air Quality Department’s enforcement division is responsible for settling Notices of Violation issued for alleged air quality violations within Maricopa County. Enforcement action taken on local companies violating clean air rules and regulations will be published by the department on a monthly basis.
If you see an air quality violation, you are encouraged to call the Air Quality Department at 602-372-2703. You may also report a violation on our website. Remember to provide as much detail as possible including location of the violation, date, time and information on what you see.
How to read the table: The “Notes” column ties the alleged air quality violation to air pollution control rules and regulation numbers. Details on those rule numbers may be found on our website: http://www.maricopa.gov/aq/divisions/planning_analysis/Default.aspx.
Trackout is defined as dust or material that may adhere to and form into a mass on the surfaces of motor vehicles, haul trucks and/or equipment (including tires) and such material has fallen or been deposited onto a paved area accessible to the public. Trackout includes carryout, spillage and/or erosion.
