Trucks may obtain a permit to carry a load that is leaking fluids if they are (1) transporting food processing plant by-products to be used for livestock feed or fertilizer, or (2) transporting agricultural products that are leaking fluid while the trucks are enroute from the place of harvest to a place where the products will be processed, stored, or sold.
Oregon Administrative Rules, OAR 734-077-0040 specify that fluid leakage is permitted only if it will not create a safety or health hazard to the general public. A permit may be revoked if there is excessive loss of fluid containing residue that can cloud the windshields of other vehicles, create a build-up causing slippery pavement conditions, or cause unsanitary conditions adjacent to restaurants, businesses, or residences.
Under ORS 818.220(1)(d) and (e) ODOT may at its discretion require the applicant to furnish satisfactory evidence of public liability and property damage insurance.
