Immediate disposition means a direct method of disposition of dead human remains by way of immediate burial or immediate cremation. Immediate disposition company means any business, other than a licensed funeral establishment, where a licensed funeral service practitioner operates the business of immediate disposition and where business records are kept.
A person may not operate an immediate disposition company unless the immediate disposition company meets the necessary requirements. An immediate disposition company must: (a) Be licensed at a fixed location under ORS 692.146; and (b) Be operated by a licensed funeral service practitioner.
An Immediate Disposition Company shall only: (a) Arrange for immediate burials and immediate cremations without public viewing, visitation or ceremony with the human remains present, except for a graveside service; and (b) If minimum preparation of a human remains is requested by the family, for purposes of having an "identification viewing," the immediate disposition company shall refer the family to a licensed funeral establishment to provide those services. |

| Prerequisites: |
The Oregon Mortuary and Cemetery Board shall issue a license to an immediate disposition company if the person who will operate the immediate disposition company applies to the Board for a license on a form provided by the Board.
Each licensed facility must be registered with the Board by its true corporate, firm or individual name. In addition, one assumed business name (ABN), as registered with the Corporation Division, may be used by each licensed facility. The name shall contain the identification of the activity, business or profession of funeral service as set forth in ORS Chapter 692 and the rules adopted thereto. This identified name shall be the registered name with the Board and shall also be utilized as the advertised name of the immediate disposition company.
OAR 830-040-0040 provides that all license applications shall specify the real and true names of the person(s) who own or have an interest in the business proposed for licensure, including percentages of ownership and corporate information. Applications must also specify the names of all principals. If the principal is a corporation, the application shall include the names of all principals of that corporation.
Principal means those persons who have controlling authority over the licensed facility, including but not limited to: (a) Managers or other persons who have decision making authority and whose primary duties include control over the operation of the licensed facility; (b) Officers or directors who have some degree of responsibility for the operation of the licensed facility; (c) Stock holders or corporations who own or control ten percent or more of the licensed facility by owning or controlling ten percent or more of the voting stock; and (d) Partners.
All applicants for a immediate disposition company license and principals of licensed facilities must submit to a background investigation.
Each branch of a licenseeýs immediate disposition company is a separate establishment and must be licensed at a fixed place of business.
If the immediate disposition company is conducting preneed sales of funeral goods and services funded by trusts, it must be registered with the Department of Consumer and Business Services and comply with the provisions of ORS 97.923 to 97.949. |

Prerequisites
The Board shall mail a notice to each licensed immediate disposition company, addressed to the licensee at the licensee's last-known address, a notice that the renewal fee is due and payable and that if the fee is not paid by the renewal date the immediate disposition company license shall lapse.
The notice will be mailed on or before November 1 of each even numbered year. The renewal form must be completed and returned with the renewal fee by December 31.
If the renewal is postmarked after December 31, the licensee must include a reinstatement fee of $50 per license. Failure to renew and pay all fees within 90 days of December 31 will result in a permanently lapsed immediate disposition company license.
