Application for sale transfer of Taxicab Business Licence

Anyone wishing to purchase an existing taxicab business licence must complete the application for sale transfer form and provide all documents required for the transfer of a taxicab business licence.

 

Application for a Taxicab Business Licence

Anyone wishing to apply for a new taxicab business licence or to change an existing taxicab business licence to another category should provide the Taxicab Board with a business plan.

The Business Plan

  • The business plan should contain enough information about the business that you wish to operate to allow the Taxicab Board to make a decision whether a taxicab business licence should be granted.
  • As a businessperson, it is in your interest to complete a business plan. This document will provide you with an objective view of the market, your customers, your competition, how ready are you to do business, and what the financial implications are of your decision to invest in this enterprise.

The Process

  • The first step in making an application to the Taxicab Board for a taxicab business licence is to submit a proposal for a taxicab business licence.
  • The Taxicab Board has prepared a guideline for a business plan that makes up the application for the taxicab business licence.
  • Once you have completed the business plan, the Taxicab Board will accept your application for a taxicab business licence.
  • The Taxicab Board will send notice to the taxicab industry that you have made application for a taxicab business licence. 
  • A hearing with the Taxicab Board will be scheduled.
  • The taxicab industry and the public may file opposition to your application for a taxicab business licence.
  • The Taxicab Board members and staff will review the business plan.
  • Only the cover page and the executive summary of your business plan will be made available to the public. The rest of your business plan will be treated as confidential and personal information.

Taxicab Board Hearing for an Application

  • The Taxicab Board will hear oral presentations with regard to your application.
  • The applicant will speak first to the Taxicab Board members and present his case and reasons why a taxicab business licence should be granted.
  • The Taxicab Board members may ask questions to clarify any information.
  • The Board will then give anyone who filed opposition to your application to present their reasons for opposition.
  • The Board may ask for further clarification from the opponent or the applicant.
  • Once the hearing presentations are complete, the Taxicab Board members will make their decision at the conclusion of the hearing. A decision will be made known later that day.
  • The applicant will be advised of the Taxicab Board decision in writing.
  • If approved, the applicant must activate the new taxicab business licence (TBL) within 30 days of the date of the letter where the Board has approved the licence application.
  • If the applicant cannot activate the new authority within 30 days, then a written request for an extension must be submitted to the Board explaining why the new authority has not been activated as well as a timeframe as to when the new authority can be activated. The Board will then make a decision to extend the activation period beyond 30 days or forfeit the approval.
  • If an applicant is denied, a person may apply to the Manitoba Court of Appeal to appeal the decision of the Board on a question of jurisdiction or law within thirty (30) days of the date of approval. In addition, the applicant cannot re-apply for the same category of licence for a minimum period of 120 days from the date of the last Board decision. This would allow the applicant to complete the appeal process if desired. It would also allow the applicant to review and revise the application prior to scheduling a hearing before the Board.
  • An application for a new taxicab business licence may be subject to a hearing fee to cover the cost of administration and the Board members attending a hearing. It will be a Board decision if a fee will be charged.

Business Plan

Applicants who wish to apply for a taxicab business licence must complete a business plan. The following information can be used a guide in developing your business plan and for presentation to the Taxicab Board. If you have any questions about the business plan or require any assistance please contact the Taxicab Board Office at (204)945-8919.

Note: 

All the information in the business plan will be kept confidential and not shared with the taxicab industry or your competition. This information will be used by the Taxicab Board to make a decision concerning your request for a taxicab business licence. Only the information on the cover sheet and the executive summary will be shared with the industry. 

Cover Page:

  • Company name (copy of incorporation from Companies Office), or applicant's name
  • The application is for (#) and class of taxicab business licence
  • Name and address of applicant
  • Dispatch company affiliation (copy of incorporation from Companies Office)
  • Contact person with regard to this application, name, address and telephone #
  • Statement of certification
  • Date and signature of applicant

Executive Summary:

  • What is the mission or objective, the reason for being of your proposed business
  • What are the main elements of your proposed business activity?
  • How long has the company been in business?
  • What management and business experience does the applicant or other partners bring to this business?
  • What services or products are you proposing to offer?

Marketing Plan:

  • What is the business climate in the area where you will operate your business?
  • What is the trend based on recent data or experience?
  • Who are your customers?
  • Who is your competition?
  • Is there a demand for your services or product?
  • How is your proposed service or product different or new in the marketplace?
  • How will you attract customers? Advertising, word of mouth, etc.
  • What is your plan to make sure your business is successful?
  • What segment of the market are you focusing your efforts?
  • What is your proposed price structure? What will you charge?
  • How will you get paid, cash, credit, monthly billing on contracts?
  • Are there any additional sources of revenue, advertising, courier services, charters?

Standards of Service Quality:

  • Do you have a company policy manual or customer service policy?
  • Do you have any company rules and regulations? How do you deal with customer complaints?
  • How will you monitor customer service and customer satisfaction?
  • What tools will you use to obtain information that your company is providing good or bad service?
  • Timely service, for example a taxicab within 15 minutes, dispatch services, on demand, curb to curb, door to door, advance bookings, etc.
  • What business identification do you use to promote your company image? Provide a sample of company logo, decals, uniform, patches etc.
  • What is your customer service policy? Do you have a written copy of your company policy?
  • Is your company flexible to meet customer needs? For example how would you deal with passenger with disabilities, children, group outings, site seeing tours?

Human Resources:

  • If you hire a driver you have a human resource issue and you need to be able to manage that employee.
  • How many employees will your company employ?
  • What will these employees do? Management, dispatch, drivers, mechanic, bookkeeper.
  • What experience do you and your employees bring to the business?
  • Do you have a job description for each position?
  • Do you have a training program for new employees?
  • What skills or requirements do employees need in order to work for your company? For example Class 4 driver's licence, taxicab business licence, first aid training, apprenticeship, etc.
  • What ongoing training does your company offer for its employees?
  • Do you have a compensation package in place to cover wages, commissions, employee benefits, etc? Will drivers be paid a wage or commission?

Vehicles:

  • Provide a list of vehicles, year, model, options and special features, and certification such as D409, safety report, mileage of vehicle (new or used).
  • Do you have a vehicle maintenance program to service your vehicle(s)?

Finances:

  • What is the cost of your proposed business activity? How will you finance your new vehicle and other business costs? Are you putting in cash or will you need to borrow money?
  • Projected statement of income and expenses for your proposed business activity.
  • Provide an estimate of potential revenue and expenses for the next two years. Your accountant or bookkeeper can help you prepare this estimate.
  • Provide a balance sheet showing your assets, liabilities, and net worth for the business.
  • Who will be doing your bookkeeping or accounting? They can help you prepare this statement. You will need this information to report to Revenue Canada when you file your annual income tax report.
