The Delaware River Basin Commission (Delaware, New Jersey, Pennsylvania, New York State, and the Federal Government) at its December 10, 2008 public meeting withdrew the proposed amendments to the DRBC Water Code published on December 3, 2007 and directed staff to develop new proposed amendments to the Water Code for public notice and comment by or in the summer of 2009 (or as soon thereafter as practicable).
Katherine Bunting-Howarth, who represents Delaware Governor Ruth Ann Minner on the DRBC, presented a statement on behalf of the commissioners regarding the FFMP and related DRBC rulemaking at the December 10, 2008 DRBC Meeting.
William Muszynski, DRBC Water Resources Management Branch Manager, gave a presentation to the Regulated Flow Advisory Committee (RFAC) on December 11, 2008 regarding DRBC's withdrawal of the proposed amendments to the Water Code.
The FFMP agreement reached by the Parties to the 1954 U.S. Supreme Court Decree continues to be implemented on a temporary basis by the Decree Parties through May 2011. The current agreement (which reflects changes to the September 2007 FFMP agreement as explained in Commissioner Bunting-Howarth's December 10, 2008 statement) can be viewed on the web site of the Office of the Delaware River Master, which administers the provisions of the Decree.
