Frequently Asked Questions About the Changes to the FLSA

  • Why did my exempt status change?
    Recent updates to federal legislation have changed the criteria used to determine exempt and non-exempt status for employees. Based on the new legislation, you now fall under the overtime protection of the Fair Labor Standards Act. The intent is to ensure that these employees are paid for all hours they work.
  • Do I have to complete a time card?
    Yes.  You must complete a biweekly time card. Your business office can direct you to your time administrator, and they can help you fill out the card.
  • How do I record regular and overtime hours?
    Record hours worked to the nearest tenth of an hour in the appropriate categories on the time card.  Both the employee and the supervisor must certify by signature to the completeness and accuracy of the information provided. Your department will tell you when your timecard is due. Be sure to submit it by the due date and time.
  • Will this affect how I accrue leave (vacation, sick leave, etc.)?
    No, you will accrue vacation and sick leave just as you always have. You will need to record vacation hours on your biweekly time card in no less than 1 hour increments (University Policy C-45). Sick leave may be recorded to the nearest 10th of an hour (University Policy C-46).
  • Will any of my other benefits change?
    Your benefits will be grandfathered as long as you remain in your current position. You will continue to receive TIAA retirement benefits.
  • What happens to my benefits if I transfer to a different position?
    Should you choose to transfer to a different position in the same employee group, your benefits will remain grandfathered. If you move to a clerical or service position, your benefits will change to those offered for that particular employee group.
  • Do I have a choice of retaining my exempt status?
    No, the Fair Labor Standards Act and other regulatory guidance dictate exemption status. 
  • Will this change my title?
    In some instances, it may be necessary to change titles.
