MOST RECENT NOTICE OF APPLICATIONS RECEIVED (NAR)

The Commission recently received applications from the sponsors of the following projects for approval pursuant to Section 3.8, Article 11, and/or Article 10.3 of the Delaware River Basin Compact. These projects currently are under review by the Commission staff in consultation with other public agencies. Individuals or organizations having a special interest in any projects or information relating to a project's impacts on water and related land resources of the Delaware River Basin are invited to submit written comments to the Commission's Executive Director, Carol R. Collier. Please refer to the appropriate docket number, listed below, on all correspondence. Such public hearings as may be required for these projects will be announced at a later date in accordance with the Commission's Rules of Practice and Procedure. Please refer to the Commission's website (www.nj.gov/drbc/dockets/status.htm) to track the status of these projects.

  1. Solvay Solexis D-69-84-3.  An application for approval of a ground water withdrawal project to reduce supply from 72.96 million gallons per thirty days (mg/30 days) to 58.05 mg/30 days of water to the applicant’s industrial supply distribution system from new wells nos. 30-01174 and 30-01173. This decrease is required to obtain NJDEP’s approval to extract ground water from four recovery wells as a part of a ground water remediation system. The project is located in the Upper and Lower Potomac-Raritan-Magothy Formation in the Delaware River Watershed in West Deptford Township, Gloucester County, New Jersey.

  2. Knoll, Inc. D-1974-162-3.  An application for the renewal of a 0.073 million gallons per day (mgd) discharge of industrial waste and non-contact cooling water from Knoll, Inc.’s industrial wastewater treatment plant (IWTP). The project IWTP discharges to the Perkiomen Creek, which is a tributary of the Schuylkill River. The project IWTP is located in Upper Hanover Township, Montgomery County, Pennsylvania. 

  3. Borough of Bally D-78-19 CP-2.  An application for approval of a ground water withdrawal project to supply up to 9.70 mg/30 days of water to the applicant’s public water supply system from new Well No. 4 and to increase the existing withdrawal from all wells from 9.70 mg/30 days to 19.42 mg/30 days. The increased allocation is requested in order to meet projected increases in service area demand. Well No. 4 will replace existing Well No. 3 as a water supply well because Well No. 3 has become an unreliable source due to local groundwater contamination. The applicant requests that the existing allocation for Well No. 3 (9.70 mg/30 days) be continued in conjunction with approval of the requested increase from Well No. 4 (9.70 mg/30) in order to accommodate continuing remediation of the contaminated portion of the aquifer. The water allocated to Well No. 3 will not be used in the public water system. The project is located in the Leithsville Formation in the Perkiomen Creek Watershed in Bally Borough and Washington Township, Berks County, Pennsylvania.

  4. Landis Sewerage Authority D-86-52 CP-2.  An application for approval of the expansion of the Landis Sewerage Authority waste water treatment plant (WWTP). The application is for an increase in discharge from 8.2 mgd to 10.2 mgd. A previous Notice of Application Received was issued on April 5, 1999 for an application to expand the plant to 12.2 mgd. Because the project did not go forward as proposed, the Commission did not act on the earlier application. The WWTP utilizes 100% land application of treated effluent at this facility. The project is located in the Maurice River Watershed, in the Cohansey Formation, in the City of Vineland, Cumberland County, New Jersey. 

  5. Croda, Inc., Docket No. D-88-74-3.  An application for the renewal of a ground and surface water withdrawal project to increase withdrawal from 60.04 mg/30 days to 76.63 mg/30 days from existing Wells Nos. 8, 9, 10, 11, and 12 and to retain the existing allocation of 470.59 mg/30 days from Intake 1 to supply the applicant’s industrial facility. The project ground water withdrawals are located in the Potomac Formation in the Brandywine-Christina Watershed. The project surface water withdrawal is located on the west bank of the Delaware River, in Water Quality Management Zone 5. The project is located south of Interstate Route 295 in New Castle County, Delaware.

  6. Shoemakersville D-93-74 CP-2.  An application for the expansion of the Shoemakersville WWTP from 0.60 mgd to 0.75 mgd. The project is located on the Schuylkill River at River Mile 92.47 – 92.3, in the Borough of Shoemakersville, Berks County, Pennsylvania. 

  7. DS Waters of America and Nestlé Waters North America Inc. D-97-46-3.  An application for the renewal of a spring water withdrawal project to continue withdrawal of 9.0 mg/30 days to supply the applicant’s spring water bottling facility from existing springs nos. 1 and 3 in the Tulpehocken Creek Watershed in the Richland and Leithsville Formations. The project is located in Millcreek Township, Lebanon County, Pennsylvania. Additionally, Nestlé Waters North America Inc. has requested consideration for approval to become a joint docket holder and has proposed to add an exportation site in Breinigsville, Lehigh County, Pennsylvania to the current exportation site in West Earl Township, Lancaster County, Pennsylvania for the 0.300 mgd of water that is to be withdrawn.

  8. Floyd G. Hersh, Inc. D-98-7-2.  An application for the renewal of a ground water withdrawal project to continue withdrawal of 3.750 mg/30 days to supply the applicant’s golf course irrigation system from existing Well No. PW-1 in the Brunswick Formation. The project is located in the Perkiomen - Macoby Creek Watershed in Marlborough Township, Montgomery County, Pennsylvania and is located in the Southeastern Pennsylvania Ground Water Protected Area. 

  9. Upper Uwchlan Township D-2000-55 CP-2.  An application for approval of the expansion and modification of the Upper Uwchlan Township Route 100 Regional Wastewater Treatment Plant from 0.3 mgd to 0.6 mgd. The WWTP is located in Upper Uwchlan Township, Chester County, Pennsylvania. The WWTP will serve existing and proposed development along the Route 100 corridor in Upper Uwchlan Township, Chester County, Pennsylvania. The WWTP will discharge treated effluent to open space in new subdivisions being developed within the service area in the Pickering Creek and Marsh Creek watersheds, using both drip dispersal and spray irrigation.

  10. Lehigh County Authority D-2001-20 CP-3.  An application for approval of Replacement Well No. WL-8 in the applicant’s water supply system, to replace Well No. WL-8, which has become an unreliable source of supply. The applicant requests that the withdrawal from Replacement Well No. WL-8 be limited to 56.16 mg/30 days of water, and that the total withdrawal from all wells remain limited to 256.24 mg/30 days. The project is located in the Allentown Formation in the Little Lehigh Creek Watershed in Upper Macungie Township, Lehigh County, Pennsylvania. The site is located within the drainage area to the section of the non-tidal Delaware River known as the Lower Delaware, which is designated as Special Protection Waters.

  11. Penn Estate Utilities, Inc. D-2003-36 CP-2An application for approval of a ground water withdrawal project to supply up to 2.64 mg/30 days of water to the applicant’s public water supply system from new Well No. 8 and to increase the existing withdrawal from all wells from 10.80 mg/30 days to 12.025 mg/30 days. The increased allocation is requested in order to meet current needs in service area demand. The project is located in the Trimmers Rock Formation in the Brodhead Creek Watershed in Stroud Township, Monroe County, Pennsylvania. The site is located within the drainage area to the section of the non-tidal Delaware River known as the Middle Delaware, which is designated as Special Protection Waters.

  12. Tidewater Utilities, Inc. D-2004-24 CP-2.  An application for approval of a ground water withdrawal project to supply up to 88.977 mg/30 days of water to the applicant’s water supply system from new and existing wells nos. C-01, C-02, RG-01, RG-02, GG-02, GG-03, JL-01, JL-02, JL-03, and WF-01, and to increase the withdrawal from all wells from 18.5055 mg/30 days to 88.977 mg/30 days. Tidewater Utilities, Inc. plans to combine the Camden Park, Generals Green, Jonathan’s Landing, and Woodfield withdrawal wells under a single groundwater withdrawal docket. The increased allocation is requested to include all current withdrawals under a single docket and to meet projected increases in service area demand. With the exception of the Woodfield Well WF-01, the project wells are located in the Cheswold Aquifer in the St. Jones River Watershed in the Towns of Camden, Dover, and Magnolia, Kent County, Delaware. The Woodfield well is located in the Federalsburg Aquifer in the Town of Woodside, Kent County, Delaware.

  13. FPL Energy Marcus Hook, L.P. D-2008-21-1.  An application for approval to construct a new 4.32 mgd outfall for the purpose of redirecting processed wastewater. The discharge will consist of cooling tower blowdown and low volume waste streams directed to a newly constructed submerged outfall located along Sunoco’s off-loading pier. The project will discharge to Zone 4 of the Delaware River. The facility is located in Marcus Hook Borough, Delaware County, Pennsylvania.

  14. Steven Parisi / Falling Creek Investment LLC D-2008-22-1.  An application for approval of the construction of The Woods WWTP, a 31,250 gpd facility that is proposed to discharge to a holding pond for spray irrigation. The project is located within the drainage area of the section of the non-tidal Delaware River known as the Lower Delaware, which is designated as Special Protection Waters. The project is located in the Pohopoco Creek Watershed, in Polk Township, Monroe County, Pennsylvania.  

  15. Blue Mountain Ski Area D-2008-23-1.  An application for approval of the expansion of the Blue Mountain Ski Area WWTP from 25,000 gallons per day (gpd) to 60,000 gpd. The project WWTP is located in Lower Towamensing Township, Carbon County, Pennsylvania. The WWTP currently discharges to Buckwa Creek, which is tributary to Aquashicola Creek. Upon approval the discharge location will be directly to Aquashicola Creek. Aquashicola Creek is a tributary of the Lehigh River, and the project WWTP is located within the drainage area of the section of the non-tidal Delaware River known as the Lower Delaware, which is classified as Special Protection Waters. 

  16. Cortese Landfill PRP Group D-2008-24-1.  An application to discharge up to 72,000 gpd to the Delaware River via the Town of Tusten’s WWTP outfall from a groundwater extraction and treatment system at the Cortese Landfill Site in Narrowsburg, New York. The proposed discharge is located in the Town of Tusten, Sullivan County, New York. The project will discharge to the non-tidal Delaware River know as the Upper Delaware, which is designated as Special Protection Waters.

  17. Aqua Pennsylvania, Inc. D-2008-25-1.  An application for approval of the existing 0.150 mgd Ridley Creek Water Filtration Plant discharge. The discharge consists of filter backwash from the applicant’s water filtration plant. The project discharges to Ridley Creek, which is a tributary to the Delaware River within Water Quality Zone 4. The project is located in Middletown Township, Delaware County, Pennsylvania.
