In August 2000, a final regulation published in the Federal Register moved the procurement procedure requirements for the Child Nutrition Programs from Department regulation 7 CFR Part 3015 to 7 CFR Parts 3016 and 3019. Attached are a number of
questions and answers we have received concerning how these requirements changed the procurement procedures for public and nonprofit school food authorities (SFAs). This memorandum has been reviewed by the Department’s Office of the General Counsel.
Please provide this information to your State agencies (SAs) and request that it is shared with all SFAs. We also encourage each SFA to share this information with their legal counsel and recommend each SA share this information with the chief State legal official.
