The attached proposed regulation implements the requirements of sections 102, 103(a) and (b), 111(b) and (e) and 112 of the Family Support Act of 1988 (P.L. 100-485) by revising current regulations to require payment to the family of the first $50 of child support payments for each month which were made in the month when due; to require that State guidelines be used as a rebuttable presumption of support levels; to require the child and all other parties in a contested paternity case to submit to genetic testing upon request; to specify that the requirement for a State law permitting paternity establishment up to a child`s eighteenth birthday also applies to any child for whom a paternity action was previously dismissed under a statute of limitations of less than 18 years; and to provide 90 percent Federal matching for laboratory costs incurred in determining paternity.

AT-89-11, Cooperation to Pursue Third Party Health Coverage

Proposed regulations published by the Office of Family Assistance, FSA, that implement section 12304 of the Consolidated Budget Reconciliation Act (COBRA) of 1985 which requires each applicant or recipient to cooperate with the State in identifying and providing information to assist States in pursuing any third party who may be liable to pay for care and services available under State plans for medical assistance under title XIX, unless such individual has good cuase for refusing to cooperate as determined by the Stae agency in accordance with standards prescribed by the Secretary. The regualtaions are applicable to the AFDC program in all jurisdictions.

AT-89-10, Extension of IV-D CSEservices to Medicaid-only Applicants and Recipients and to Former AFDC Recipients.

Proposed regulations implement the requirements of sections 9141 and 9142 of the Omnibus Budget Reconciliation Act (OBRA) of 1987 (P.L. 100-203), which amended title IV-D of the Social Security Act (the Act). Section 9141, effective December 22, 1987, amended section 457(c) of the Act to require State IV-D agencies to provide appropriate notice and to continue to provide IV-D services to persons no longer eligible for Aid to Families with Dependent Children (AFDC) under title IV-A of the Act.

Final regulations that implement section 9103 of the Omnibus Budget Reconciliation Act of 1986, P.L. 99-509, which amends title IV-D of the Social Security Act (the Act), effective October 21, 1986. Section 9103 requires that, as a condition of IV-D State plan approval, States have in effect laws requiring the use of procedures prohibiting the retroactive modification of child support arrearages.

This action transmittal contains a notice regarding a final rule on medical support enforcement. This final rule was effective on September 16, 1988 (54 FR 36014), except for the information collection requirements in ?306.51(b)(3) and (b)(5) which were pending OMB approval. OMB approved these information collection requirements on December 20, 1988 under OMB control number 0970-0070. This notice is to inform the public that the provisions of ?306.51(b)(3) and (b)(5) are now in effect.

AT-89-03, Measurement and Reporting of State Paternity Establishment Percentages.

AT-89-02,Child Support Enforcement Program Audit

These are proposed regulations which are intended to improve and expedite the current process for auditing State and local IV-D programs by consolidating the criteria evaluated during the course of an audit and making other changes to the current requirements to allow flexibility in the audit approach. These changes are being proposed in order to simplify the current audit process, to ensure the initiation of audits as close as possible to the time period audited, and to shorten the elapsed from audit initiation to issuance of a final report.

AT-89-01,Revisions to financial reporting requirements to conform with recent legislation.

The revised statute eliminates this different treatment and requires that collections received on behalf of former AFDC recipients be distributed and processed in the same manner as other non-AFDC collections (with the exception of the treatment of any amount applied to an AFDC arrearage amount as explained below), thereby effectively eliminating the five-month "transitional" period.
