OCSE is working in collaboration with the IRS to encourage State and local child support offices to provide information to low and moderate income working individuals and families regarding the Earned Income Tax Credit (EITC). The EITC is a refundable Federal income tax credit. When the TITC exceeds the amount of taxes owed, individuals who claim and qualify for the credit are eligible for a tax refund.

The NPRM implementing provisions of title IV-D of the Social Security Act as amended by the DRA was published in the Federal Register on January 24, 2007. Questions concerning the impact of the requirement for cooperation with the IV-D program as a condition of receipt of eligibility for the Food Stamp program were raised during the comment period. Those comments will be addressed in the final regulation. The Food Stamp agency worked with OCSE in developing the attached guidance. This guidance reflects both agenciesâ¿¿ view of the appropriate methods of collection of the $25 fee when Food Stamp recipients are required to cooperate with child support enforcement.

This Information Memorandum conveys â¿¿Tribal and State Jurisdiction to Establish and Enforce Child Support.â¿¿ This is an update of a publication that was written in 1991 entitled â¿¿Tribal and State Reciprocity in the Establishment and Enforcement of Child Support.â¿¿ When the original document was published, Tribes and Tribal organizations did not have access to direct funding to operate IV-D programs. OCSE formed a Tribal/State Cooperation workgroup after the publication of the final rule, and among other things, discussed appropriate training material for use in Tribal and State IV-D programs. Though the workgroup found the original document useful, it was dated because of the significant changes in child support case processing relating to Tribes.

The final rule for Tribal Child Support Enforcement Programs was published in the Federal Register on March 30, 2004 (69 FR 16638) implementing section 455(f) of the Social Security Act. One of the requirements contained in the rule relates to the distribution of child support collections. This training curriculum was developed for use by start-up Tribal IV-D programs and comprehensive Tribal IV-D program staff, Tribal caseworkers, members of the National Tribal Child Support Association and anyone who is interested in learning about Tribal distribution.
