Local child support staff will assist custodial parents in filing a petition with the Family Court in order to obtain a child support order. Information regarding the non-custodial parent's ability to pay is presented to the court for use in calculating the support amount.

In New York State, Titles 6-A and 6-B of the New York State Social Services Law set forth the child support enforcement program authority and Articles 4, 5, 5-A and 5-B of the Family Court Act and Sections 236 and 240 of the Domestic Relations Law are the principal provisions for paternity and support proceedings.

For children born to unmarried parents, unless paternity is established, there is no legal relationship between the father and the child. This legal relationship can be established either by completing a voluntary Acknowledgment of Paternity form or by filing a paternity petition in court.
