For FY 2003, the budget does not include funds for the Byrne Discretionary Grant Program, a reduction of $94,489,000.  The original purpose of this program, which was to give the Department discretionary funding for anti-drug activities, has not been possible in recent years due to the level of earmarking within this program, which has limited OJP's ability to address new and innovative criminal justice initiatives.  Traditionally, the discretionary grant program served as a vehicle to fund OJP and Administration initiatives in the area of state and local criminal justice improvements in topics ranging form gun safety, drug testing, alternatives to incarceration, and community-based justice.  In 2002, 100 percent of the discretionary program was earmarked.

Residential Substance Abuse Treatment Program

This program provides formula grants to states for use by state and local government to develop and implement residential substance abuse programs within state and local correctional and detention facilities where inmates are incarcerated for a sufficient period of time to permit such treatment.  RSAT funds also used to provide for transitional substance abuse treatment  upon an inmate's release.  This increase will provide a total of $77,000,000 for RSAT.

This is a competitive, discretionary grant program designed to help communities plan, implement, and enhance drug courts.   The grants provided under this program assist jurisdictions in establishing programs that provide: early identification, referral and screening; intensive, continuous judicial supervision; frequent, random drug testing; coordinated, comprehensive, and appropriate substance abuse treatment services; regular status hearings at which the supervising judicial offical reviews the progress of each participating defendant; appropriate and specific responses to a defendant's compliance or non-compliance with drug court program requirements; and ongoing criminal justice supervision through pretrial, probation, or other release programs using monitoring, tracking, and case management.
