Approximately 1,850 current and former state employees are entitled to additional contributions to their PERS accounts as a result of the resolution of their challenge to the state’s calculation of overtime salary during 1995 to 1997 (referred to as the “Young Case”).
If you are part of the Young Case class action suit, you were notified by mail.
Young Case 2 member account adjustments began in February 2008 and are scheduled to be completed in February 2009. Members will receive a letter once their account is adjusted. PERS’ actions and estimated timelines are shown below.
- Non-retired members impacted only by Young Case 2 (February – May 2008)
PERS will apply additional contributions and earnings retroactively for members who are not currently receiving a benefit. We adjusted approximately 75 percent of these accounts in time to be included on a member’s 2007 annual statement. We expect to complete the remainder by July 1, 2008 and the adjustment will be included on the member’s 2008 annual statement.
- Retired members impacted by Young Case 2 and Strunk and Eugene Adjustments (March – June 2008)
PERS will apply additional contributions and earnings retroactively. The Strunk and Eugene Adjustment Section will adjust and re-calculate retirement benefits retroactively to the retirement date.
- Retired members impacted only by Young Case 2 (April – August 2008)
PERS will apply additional contributions and earnings retroactively. Young Case 2 staff will adjust and re-calculate benefits for retirements retroactively to the retirement date.
- Members impacted by Young Case 2 with special conditions (June – October 2008)
PERS will apply additional contributions and earnings to member accounts with special conditions, e.g., divorce, refunds, deceased, etc. We will also review potential adjustments for any benefits paid out (refunds, death benefits).
- Adjust accounts needing additional research (June 2008 – February 2009)
Accounts needing additional research may extend beyond these timelines.
