This case arises under the employee protection provision of the Energy Reorganization Act of 1974, as amended (ERA), 42 U.S.C. § 5851 (1982). Before me for review is the [recommended] Order of Dismissal issued on November 21, 1985, by Administrative Law Judge (ALJ) Richard E. Huddleston and recently forwarded to me. 29 C.F.R. § 24.6(a) 11988). The record reveals that prior to a hearing on his complaint, Petitioner notified the ALJ by letter from his counsel dated November 12, 1985, that he had withdrawn his complaint in this case. [Page 2]
Upon review of the record in this case and the [recommended] order of Dismissal, I accept the ALJ's recommendation. Accordingly, the complaint in this case is hereby DISMISSED. SO ORDERED.
