Holly Gates, 91-SCA-9 (ALJ June 21, 1996)

Date Issued: June 21, 1996
Case Number: 91-SCA-9

In the Matter of

HOLLY GATES
     Respondent

                         ORDER OF DISMISSAL

This case arises under the McNamara-O'Hara Service Contract
Act (SCA), 41 U.S.C. § 351 et seq, and the applicable
regulations issued at 29 C.F.R. Parts 4, 6, and 18.

On October 29, 1990, the Department of Labor (DOL) filed a
Complaint in this Office against Respondent alleging that
Respondent violated the above-mentioned Act and regulations. On
November 27, 1990, Respondent filed a request for a hearing.

Thereafter, on May 3, 1996, DOL filed a Motion to Withdraw
Complaint stating that no funds had been withheld from Respondent
and that no other government contracts were let to Respondent
since she was no longer in the mail hauling business. DOL states
that assuming back wages could not be collected from respondent
and the need for debarment has been eliminated, this matter may
be administratively closed.

The Motion to Withdraw Complaint is GRANTED and this matter
is administratively closed.

So ORDERED,

                                        _________________________
