GIPSA Alleges McAndrews Livestock Company, Inc. and John McAndrews Violated the Packers and Stockyards Act

 
WASHINGTON, June 24, 2008 - The U.S. Department of Agriculture's Grain Inspection, Packers and Stockyards Administration (GIPSA) has found evidence that McAndrews Livestock Company, Inc. (McAndrews Livestock) and John McAndrews, Garnavillo, Iowa:

 
  • issued checks without having sufficient funds to cover checks;
  • failed to pay the full purchase price for livestock purchased within the time period required by the Packers and Stockyards (P&S) Act; and
  • failed to pay the full amount due to livestock sellers.

 
On June 18, 2008, GIPSA filed a complaint against McAndrews Livestock and JohnMcAndrews. If the allegations are admitted, or proven in an oral hearing, McAndrews Livestock and John McAndrews may be ordered to cease and desist from violating the P&S Act, suspended and assessed a civil penalty.

 
McAndrews Livestock is registered with the Secretary of Agriculture as a dealer to buy and sell livestock in commerce for its own account and as a livestock dealer in commerce buying and selling for its own account.

 
John McAndrews is president, manager, 100% shareholder responsible for the management, direction and control of McAndrews Livestock.

 
The P&S Act is a fair trade practice and payment protection law that promotes fair and competitive marketing environments for the livestock, meat, and poultry industries.
