1. What's the mess? What's that noise?

Changes are talking place at the Research Library. Once again, things are moving, but hopefully the activity will have little impact on your being able to find books or journals on the shelves. This time, we're moving walls! Yes, WALLS!

In the area that formerly was the group office space (NW corner), two small rooms will have their common wall removed to create a training room, accommodating up to a dozen computers and about 18 students. New air conditioning for that area will be installed. The general open space near the current display issues of journals will become better user space, with larger work tables, more comfortable seating and acoustic absorbers on the walls.

In the almost opposite corner (SE) of the building, there will be construction activities also. Again, two small rooms will lose their common wall, and a space will be carved out to create a document delivery area. After the group (CIC-14) finishes its reorganization, and tasks and personnel are reassigned, a photocopy service will be instituted. Long in coming and great in demand, there will be plenty of publicity as this service is formally kicked off.

Other physical changes will occur, involving Research Library personnel. Most importantly, from an ES&H perspective, electrical code violations will be rectified. Preparations for the changes have been happening gradually over the past two weeks. The noise, dirt and commotion from the actual construction, however, will be with us through most of the month of August, but we ask your patience during the "temporary inconvenience; permanent improvement."

2. News from the Report Collection
======================================================
As part of a special project to build an optical image database of Los Alamos unclassified reports, Library staff have added brief bibliographic records for most Los Alamos formal unclassified reports not previously in the Library's online public access catalog. At a minimum, all reports will be searchable by title or title words, and report number. Both hardcopy and microfiche editions of these reports are identified. As a result of this effort, patrons now have online access to information formerly unavailable about thousands of report holdings. The Library's ultimate goal is to provide bibliographic access to all reports in the Report Collection, classified and unclassified, paper and microfiche, Los Alamos and non-Los Alamos.

If you can't locate a non-Los Alamos technical report you are looking for in the Library's online public access catalog, please check with Report Collection staff. Most of our non-Los Alamos reports are still not listed in the online catalog. Also, if the paper copy of a report you do locate in the online catalog is on loan to another patron, don't despair. Chances are good that we also have the report in microfiche. Again, check with Report Collection staff. You can borrow the microfiche on 7-day loan, or we can have a copy made for you, in either paper or microfiche.

To better accommodate a heavy volume of requests for reports, particularly during summer months, Report Collection staff are now delivering patron-requested reports to the main-level circulation desk, every hour on the hour (from 9 am - 5 pm, Monday through Friday). Allow additional time (at least 30 minutes for up to 5 reports, more time for greater than 5), once the request is received by the Report Collection, to identify and locate the reports. When making a request, please be sure to indicate if you are waiting for the reports or plan to return to the Library to pick them up. If the latter, it helps us to know when you intend to come back.

3. Where did my books go?

In an effort to better serve the patron, a new reshelving policy has been implemented. Circulation staff will pick up books and journals three times a day: 8 am, 1 pm and 4:30 pm, Monday - Friday.

Books and journal may be left in study carrels for one working day if a note is left with name, date and phone number. Items left for longer than one day will be shelved. Items left without a note will be picked up for reshelving at the regular pick-up times.

The new schedule and policy are in response to patron complaints about difficulties in finding materials kept in carrels.

4. What is a trademark?
======================================================
A trademark is defined in the amended Trademark Act of 1946 as "any word, name, symbol, or device, or any combination thereof adopted and used by a manufacturer or merchant to identify his goods and distinguish them from those manufactured or sold by others." The primary function of a trademark is to indicate source or origin of goods or merchandise. Rights to a trademark are acquired only by use and this use must continue if the rights are to be preserved. Registration of a trademark does not create or establish any exclusive rights, but it is recognition by the government of one's right to use the mark in commerce to distinguish one's goods from those of others.

Registration of a trademark by the U.S. Patent and Trademark Office (PTO) serves as legal notice throughout the country as to the ownership and claim of rights to use that trademark. An application is filed with the PTO where the application is "examined" for compliance. If the mark is determined to be registerable, it is published for opposition in the Trademark Section of the Official Gazette of the PTO. If no challenge is filed within 30 days, or if the challenge is unsuccessful, the trademark is registered for 10 years. An affidavit of continued use in commerce is required to maintain the registration.

The 1988 revision of the Trademark Act contains two significant changes. Applicants may file for a Federal trademark based on their bona fide intent to use the mark in commerce. This intent-to-use allows one to register for a trademark with the stipulation that the trademark will be used within six months. The PTO can give preliminary approval. This new feature allows corporations to test the protection potential and registrability of marks before beginning costly development and promotional programs. The second change was the shortening of the term of registrations from 20 to 10 years, thereby purging the register of defunct marks.

A trademark is property. The owner of a trademark has the right to its exclusive use and can stop its unauthorized use; however, the owner has no right to absolutely prohibit the use of the words. The owner's right of exclusive use of a trademark extents to other goods of the same general class as that to which it has been applied. The use of another's trademark without permission is unlawful unless the use is so foreign to the owner's exclusive use as to ensure against any identification, or confusion between the two.

5. Internet trademarks

In recent weeks, the U.S. Patent and Trademark Office has suspended action on approving all applications for trademarks using the word Internet. With the ever increasing financial interests being shown in regard to the Internet, the patent office is trying to determine if anybody has exclusive rights to the name Internet.

Several of the trademarks are being opposed. Internet, Inc. of Reston, Va., which operates electronic banking systems, is opposing trademark applications by the Internet Society and the Corporation for National Research Initiatives (CNRI). The Internet Society and CNRI have registered opposition against the trademarks that have already been assigned to Internet, Inc. CNRI "is taking the position that the term Internet has been in use for over 20 years and the Internet, capital I, is a major public resource and that people should be able to use this term 'Internet,' either alone or in combination." This quote comes from the Internet Letter.

Searching DIALOG's file 226 - Trademarkscan - US Federal one finds 77 trademarks using the word Internet. Below is a synopsis of the trademarks, owner, type of company, and status. These are arranged by status - registered, opposed, pending and canceled. The time frame cover 1975 to the present with a spurt of pending requests from 1993 to the present. Many of the marks are already well known - Internet World, Internet in a Box. The companies range from software, newsletter, publication companies to temporary employee placement services, pharmacy services, and travel agencies. This is definitely an issue to watch with large financial gains to be made or lost.
