Advisory 94-Enforcement of the Act The Texas Workers’ Compensation Act of 1989 has been in effect for over three years. System participants have had sufficient time to make adjustments to meet the requirements of the Act and Commission Rules. To date, the Commission has used a combination of education and minimal penalties to try to effect compliance. The Commission has noted a lot of improvement; however, some participants have not improved. Any noncompliance jeopardizes the effectiveness of the Act and the timely delivery of benefits. Because of this, the Commission will move into a more aggressive penalty strategy to obtain the compliance required to administer the Act. The Commission commends those organizations who have brought their operations into compliance and hereby issues notice that we will aggressively penalize those who have not.
