Electronic Submission of Claim Data

The Texas Worker’s Compensation Commission (TWCC) intends to require the electronic submission of certain workers’ compensation claim data from all insurance carriers. Implementation is projected to proceed according to the following schedule:

Presentation of proposed rules by September 1, 1994;

Adoption and publication of rules by November 1994 with a grace period not to extend beyond January 1, 1995.

Pilot projects will begin with previously selected carriers by the end of April 1994. The Commission expects carriers involved in the International Association of Industrial Accident Boards and Commissions (IAIABC) Electronic Data Interchange (EDI) development effort to be piloting or in production by fourth quarter of 1994.

TWCC will require records layouts and data definitions developed via the IAIABC EDI project. These layouts consist of: (1) the carrier-reported first report of injury, using the IAIABC 148 record layout; and (2) the payment data on the subsequent report of injury, using the IAIABC A49 record layout. These records correspond to information currently reported on the TWCC-1, Employers First Report of Injury or Illness, and the TWCC-21, Payment of Compensation or Notice of Refused/Disputed Claim, respectively.

Electronic submission will increase the amount of claim data provided by the carriers, but will NOT AFFECT the employer’s obligation to file a hard copy TWCC-1 with the Commission, as required by section 409.005 of the Texas Labor Code.
