The Product Safety Division was established to protect the health, safety and welfare of the people of Texas by reducing the risk of illness, injury or death resulting from the reasonable, foreseeable, and customary handling or use of hazardous, or potentially hazardous, consumer products, including children's products.

The division licenses and regulates product manufacturers and retailers, including routine product inspections and in-depth investigations of consumer complaints and injuries, illnesses or deaths related to consumer products.

The Hazardous Consumer Products Program, under the Texas Hazardous Substances Act, handles compliance over a broad range of commonly used consumer items including automotive products; household cleaners; polishes and waxes; paints and glues; infant items; children's toys; and sleep wear. This responsibility is implemented through registration of manufacturers; re-packagers and/or importers of hazardous substances; enforcement of labeling regulation, including hazard warning statements and first aid instructions appropriate for the specific product; and detention of recalled, mislabeled, and banned items. The branch also has inhalant abuse responsibilities. The Abusable Volatile Chemicals Program's objective is to eliminate the intentional inhalation of dangerous volatile chemicals. The Division's rule is to enforce the permitting, public notice and fee collection provisions of the law and to provide public education/information programs.

The Bedding Program enforces the Texas Bedding Law through a program of licensing and state wide on-site inspections of manufacturing and processing facilities, germicidal treatment operations and retail outlets; and laboratory analysis of the contents and chemical treatment of bedding products. Its purpose is to protect the consumer from illness and/or injury associated with the use of unapproved or contaminated products; protect the worker's health from exposure to unsanitary conditions in the plant; and provide the consumer with a safe, properly manufactured and labeled product.

The Tier Two Registration Section administers two programs which protect workers and the general public from hazardous material.  They are the Community Right-to-Know for citizens, community planners and emergency responders and the Worker Right-to-Know for public employees.  The branch serves as the state repository for community right-to-know information, provides outreach for compliance on both the federal and state laws, supports Local Emergency Planning Committees (LEPCs) in community right to know endeavors and administers an enforcement program.
