How do I register?
You can obtain an application and the bedding rules and regulations by calling the Texas Department of State Health Services, Regulatory Licensing Unit, 512 834-6600 ext 2438 or visit our website:

Why should I register?
If you sell, manufacture, distribute/wholesale, or import bedding products into the state of Texas, and/or you renovate, or germicidally treat used bedding you need to register.  “It is the law.”

What should I register?
TAC Rule §205.2(a)(3) Definitions
Bedding--A mattress, mattress pad, mattress protector, box spring, sofa bed studio couch, chair bed, convertible bed, convertible lounge, pillow, bolster, quilt, quilted spread, comforter, cot pad, sleeping bag, lounge chair pad, utility or all-purpose pad, crib pad, playpen pad, crib bumper pad, car bed pad, infant carrier pad, convertible stroller pad, bassinet pad, bed rest and loungetype cushion, or a stuffed or filled article that can be used by a human for sleeping or reclining.

How do I fill out the application?
Fill out the application completely; license(s) will be delayed if the application is not filled out correctly. Fill in the company name exactly how you want it to read. Make sure you have included your sales tax identification number state or federal.

Fill in the license type (see the back or the second page of the application). If you are registered with another state and want to register that number, fill it in as the uniform registry number (number that appears on the law label). If you do not have a uniform registry number (for manufacturers) one will be assigned when the license is issued.

The category number is located with the license type (see the back or the second page of the application).  You will have three tables to select (ex: License type B for bedding products, category H can ship into or within Texas 0-1,999 items; the fee amount is $220.00). If you have more than one license type for the same registration number, repeat the same steps on the next line.

Complete the billing and facility address location, officers and owner(s) of the company, and the contact. Sign and date application, include payment, and any additional information that is required.

How do I know what fee to pay?
Find the appropriate license type and the correct fees on the back or the second page of the application. The license types and fees are listed on three separate tables.

Table I
Mattress Manufacturer - if you are a manufacturer of mattresses and box springs made with all new materials. If you manufacture mattresses or mattress pads you will need to provide test results confirming compliance with federal flammability standards, Code of Federal Regulations (CFR) 1632 upon request.

Mattress Renovator - if you renovate or refurbish used mattresses Note: you must also have a germicidal treatment license to be a mattress renovator. Fees are graduated, you will estimate articles sold or shipped into Texas. Ex: you estimate the articles/items you will sell/ship into the state 300 mattresses and box springs the category would be A, the fee would be $220.00. If you sell/ship 30,000 mattresses & box springs the category would be E, the fee would be $880.00.

Table II
Bedding Products – person(s) or business(s) who manufactures bedding products other than mattresses & box springs. If you manufacture mattress pads you will need to provide test results confirming compliance with federal flammability standards. Ex: you estimate the articles/items you will sell/ship into the state. If you have estimated 300 decorative pillows, the category would be H; the fee would be $220.00. If you sell/ship 30,000 comforters, the category would be L, the fee would be $550.00.

Wholesaler – person(s) or business(s) located out of the state that sells/ships bedding products into Texas.

Distributor – person(s) or business(s) located in Texas that distributes bedding products to different locations in Texas.

Importer – person(s) or business(s) selling or shipping bedding products into the state, which are manufactured, out of the country.

Renovator – person(s) or business(s) selling or shipping used bedding products that have been renovated or refurbished in the state.

Table III
Processor – person(s) or business(s) who manufactures or processes, and sells or ships into the state any filling materials, including felt, batting, pads, or foam to be used or that could be used in bedding, other than frames or metal springs.

Arts & Crafts – a person with no employees that sells or ships into Texas less than 250 bedding products per year.

Codes for license types:

M Mattress & box springs manufacturer (all new materials)
MR Mattress & box springs renovator (must also be licensed for germicidal treatment)
B Manufacturer of bedding products (other than mattresses & box springs)
R Renovator of bedding products (must also be licensed for germicidal treatment)
D Distributor
P Processor

Can I register multiple locations on one application?
You must register each location individually (separate applications). You may register multiple license types for each location on the same application. Ex: manufacturer of mattresses & box springs (all new materials) and bedding products manufacturer (all new materials).

What if I already have a registration number from another state?
If you are registered in another state you may use that uniform registration number (this is the reg no which appears on the law label). If you are using another state’s assigned number you must submit a copy of your current license issued by that state and two actual law labels. Manufacturers or renovators of mattresses and mattress pads may be asked to submit flammability test results.

Can I pay with a credit card?
Credit cards are not accepted at this time. You may make your payments by check, money order or cashier’s check. You may come in person and pay with cash. All required documentation, application completed entirely and payment must be submitted before the license can be issued. This will take approximately 2-4 weeks.
