25 Texas Administrative Code (TAC) §289.205

The Agency has available for comment proposed revisions to Texas Regulations for Control of Radiation 25 Texas Administrative Code (TAC) §289.205 concerning hearing and enforcement procedures.  Revisions to §289.205 include the following:

• additional information intended to clarify the requirements for responding to a notice of violation,

• the term “enforcement conference” is deleted in the rule and replaced with “informal meeting”,

• the words “for each violation” are added after the word “penalty” in §289.205(j)(3)(D) to clarify that the penalty assessed takes into account each violation.,

• clarifying language is added to assist in the understanding of categories of severity levels of violations,

• additional mitigating factors are added to the list of reasons that could cause a severity level to be elevated.

Texas Regulations for Control of Radiation
25 Texas Administrative Code (TAC) §289.257

The Agency has available for comment proposed revisions to Texas Regulations for Control of Radiation 25 Texas Administrative Code (TAC) §289.257 concerning packaging and transportation of radioactive material.  Revisions to §289.257 include the following:

• New radioactivity levels for radioactive material allowed in a type A container,

• quality assurance requirements for certain type B packaging,

• new information regarding exemption from classification as fissile material,

• additional general licensing information for transporting fissile material.
