Substance Abuse HIPAA Information

HIPAA does not supercede 42 CFR Part 2 (Confidentiality of Alcohol and Drug Abuse Patient Records), and it also defers to more stringent state laws. Therefore, it is important to consider all applicable statutes and regulations when implementing HIPAA.

The Substance Abuse and Mental Health Services Administration (SAMHSA) is the federal agency charged with improving services to reduce illness, death, disability, and cost to society resulting from substance abuse and mental illness. It includes information about HIPAA on its website.
