LICENSING OF THIRD PARTY ADMINISTRATORS

An "administrator" means a person who collects premiums or contributions from or who adjusts or settles claims in connection with life, health, accident and pharmacy benefits or annuities for residents of this state. Persons who fall under this definition and are not exempted are required to have a certificate of authority before conducting business in this state.

PLEASE NOTE: Effective September 1, 2007, the definition of "administrator" is expanded to include a person who, in connection with workers' compensation benefits, collects premiums or contributions from or adjusts or settles claims for residents of this state (HB 472 enrolled 80th Legislature). Persons administering workers' compensation benefit plans who fall under this definition, who are not exempted and are not currently licensed as a third party administrator (TPA) in this state may make application using the standard TPA application available from the link below and receive a certificate of authority after September 1, 2007. A person is not required to hold a certificate of authority under Chapter 4151, Texas Insurance Code, as amended by HB 472, to administer workers' compensation benefits for an insurer before January 1, 2008.  See also HB 472 FAQs.
