Retrospective Rating Article 196

TO ALL INSURANCE COMPANIES, CORPORTIONS, EXCHANGES, MUTUALS, RECIPROCALS, ASSOCIATIONS, LLOYDS, OR OTHER INSURERS WRITING WORKERS’ COMPENSATION AND EMPLOYERS’ LIABILITY INSURANCE IN THE STATE OF TEXAS, THEIR AGENTS AND REPRESENTATIVES AND TO THE PUBLIC GENERALLY:

RE: Amendments to the Texas Basic Manual of Rules, Classifications and Experience Rating Plan for Workers' Compensation and Employers' Liability Insurance Updating Expected Loss Rate and Discount Ratio Table and Amendment to the Workers’ Compensation Classification Relativities

Notice is hereby given that the Commissioner of Insurance entered Commissioner´s Order No. 01-0010, dated January 3, 2001 amending the table of classification relativities to add Code 0923 and to show that the relativity for Code 0923 is "a" rated. The order revises the table of Expected Loss Rates and Discount Ratios by classification used in experience rating as contained in the Texas Basic Manual of Rules, Classifications and Experience Rating Plan for Workers' Compensation and Employers' Liability Insurance (the Manual) by amending the values for Code 0913 and adding the values for Code 0923.

On February 5, 2001, the Commissioner entered Commissioner´s Order No. 01-0095 to correct minor errors in Commissioner´s Order No. 01-0010. Commissioner´s Order No. 01-0095, a nunc pro tunc order, has the same effective date as Commissioner´s Order No. 01-0010. A copy of Commissioner´s Order No. 01-0095, along with attachments to the order, is attached hereto for your information.

These adopted changes are effective for workers’ compensation policies written with effective dates on and after February 3, 2001, which is 15 days after notice of the adoption of these changes appeared in the Texas Register. Copies of the revised Manual pages have been sent to those who have purchased a copy of the Manual from the Texas Department of Insurance (TDI) and requested to receive the updated pages. Copies of the Manual may be obtained from TDI at a cost of $30 per manual in accordance with the order information sheet attached to this circular or can be downloaded from the TDI WebPage at www.tdi.state.tx.us.
