Two men charged in connection with a party that served alcohol to an 18-year-old Arizona State University student before she plunged 10 floors to her death pleaded not guilty Wednesday in Maricopa County Superior Court.

David Siegal and Matthew Farberov, both 20, are charged with two counts of minor possession of liquor and one count of failing to require identification - all misdemeanors.

A third defendant, 21-year-old Alex Kraus, faces the same charges but did not make an appearance Wednesday. The judge reset Kraus' initial appearance for Oct. 16.

The party was held March 29 by members of de-certified ASU fraternity Alpha Epsilon Pi at an apartment in Tempe. An investigation by the Arizona Department of Liquor Licenses and Control found there was no oversight at the party to determine if people were 21 years old or more before they were served vodka.

Authorities say Naomi McClendon, 18, was served vodka at the party and died early March 30 from a fall at another apartment complex.

Attorney Adrian P. Fontes appeared in court Wednesday on Kraus' behalf and argued that the Maricopa County Superior Court did not have jurisdiction over Kraus, who is in New Jersey.

Fontes said the court does not have probable cause to issue a warrant for Kraus' arrest, and he asked for the case to be dismissed.

The judge denied the plea for dismissal and said that, if Kraus does not show up next time, the presiding judge will decide whether to issue a warrant for his arrest.

Siegal and Farberov are next scheduled to be in court on Sept. 24.
